Man jailed for assault

PA Auckland A man who kicked two cyclists as they lay injured after a road accident has been jailed for six months. Appearing for sentence in the District Court at Otahuhu was Lance Terini Hyland, aged 21, a sandblaster, of Palmerston North. He had earlier denied assaulting Miles Patrick Yaxley and Walter Grant Kingsford on March 30. Judge Blackwood said that he had seriously considered imposing the maximum sentence of 12 months in prison, but reduced it to six months to be served concurrently on the two charges of assault. Hyland now seemed to recognise that he deserved to go to prison for what he did, the Judge said. There was no suggestion that Hyland had caused any

injuries that the cyclists received in the accident, but for kicking somebody who was injured, even if wearing jandals. Hyland deserved no consideration, he said. The Judge accepted that Hyland did not kick the man with the broken leg. but he did stand on it. “That justifies the name I gave you of being a monster." he said. After his release from prison. Hyland was to serve 12 months probation, with the special condition that he undertake medical or psychiatric counselling or treatment for alcoholism.
