Missing file worries council

A "missing" file is worry-, ing members of the Paparua County Council’s town planning committee. The court file deals with a council prosecution made in 1978 against Hornby Holdings for a dump in McTetgues Road. A lower court decision connected with Hornby Holdings led to an appeal'by the council in the Supreme Court. Earlier this year, the concil wrote to its' lawyers asking about the appeal and possible "future actions." Last evening's meeting was’ told that the file “could not be located." The lawyers said they had been advised by the Deputy Registrar of 'the District

Court last April that the file could not be found but that a search for it would be made. Although the position was "unsatisfactory" the lawyers maintained that no further appeal action could be taken until the file was found. However, the committee recommended that the council seek a declaration under a section of the Town and Country Planning Act as to whether the property could b§ used as a dumping’tip under the council's district scheme. The committee also recommended that the council write to the Minister of Justice and the SolicitorGeneral to find out how the file could have been lost and what redress the council had.
