To enroll phone 792-577 NOTICE OF INTENTION TO INTRODUCE BILL NOTICE is hereby given of the intention of tlie Ellesmere County Council (hereinafter referred to as "the Council") to introduce into the 1982 Session of Parliament a.Local Bill entitled the Ellesmere County Council (Lump Sum Contributions) Empowering Bill. The objects which the Bill is intended to effect are—(a) To enable the Council on resolution to give ratepayers the right to elect to either pay a lump sum capital contribution or to pay an equal share of the cost of the works and loan charges by way of a rate when it proposes to raise a special loan to fund works within water supply or urban drainage areas. (b) To require the Council to prepare an estimate of the net cost of the works to calculate the estimated lump sum capital contribution payable by each ratepayer and to estimate the uniform annual charge required to pay the charges on a special loan equal to the estimated net cost of the works. (c) To require the council within' 14 days of the resolution to serve a notice on the form prescribed in the schedule to the Bill on each affected ratepayer requiring the ratepayer to advise the council within two months whether he elects to pay a lump sum capital contribution’, or to be liable for the' Tate or annual charge. (d) To deem a ratepayer who fails to make an election to have elected to pay the rates or annual charge and to make an election to pay the lump sum capital con J tribution irrevocable but to’ enable a ratepayer who has elected to pay the rates or annual charge to change his election with the Council's consent. (e) To empower the Council to raise a loan for the balance of the cost of the work less the elected total lump sum contribution. (f) To provide that any rateable property owned by a ratepayer who has elected to pay a lump sum capital contribution will be included on a special roll for the special loan and will not be liable for the special rate or any other, charge made to cover the annual charges on the loan raised to finance the works butwill be liable for the rates . or charges levied to maintain or operate the works. (g) To empower the Council to serve a notice in the form prescribed in the schedule to the Bill on every ratepayer who elected to pay. a lump sum capital contribution requiring the ratepayer to pay the estimated lump sum capital contribution within three months after the date of the notice. (h) To enable the Council to ascertain the actual cost of the works when their construction is completed and thereafter to redetermine the actual lump sum capital contribution payable. (1) To empower the Council to refund any overpayment if the actual cost of the work is less than the estimated cost or to serve a further notice in the forpi pre'scribed in the schedule requiring the ratepayer to pay a lump sum capital contribution for the balance. (j) To enable the Council to charge up to 10 per cent by resolution on any unpaid capital contributions. (k) To enable the Council to recover the lump sum capital contribution and/or any balance of it still owing as if it were a rate under the Rating /let 1967. (l) To provide for the service of notices.
