Judge dismisses one charge against Brych

NZPA-Reuter Los Angeles A Los Angeles Superior Court judge has dismissed one of 13 counts against the cancer therapist, ■ Milan Brych, who had patients in Australia and New. Zealand before coming to the United 'States.

Brych. aged 40, who is living in Arizona and is.free on bail of $200,000. is accused of conspiring to violate health and'safety codes. Judge David Aiseson, who heard pre-trial, motions on Friday, dismissed a charge that Brych- had not'regis-

tered a cancer treatment with the United States Government’s Food and Drug Administration and with the California Board of Health.

Lawyers for the prosecution said after the hearing that they were not clear why the Judge dismissed the count, but he presumably decided it was based on insufficient evidence. :

Defence lawyers < challenged the'use of a warrant to search Brych’s former home in Los Angeles and said evidence obtained during the search should not be ' used in court. Judge Aiseson said he would rule on this motion later. • ;

Judge Aisesori set February 23 as the tentative opening day for the, trial, but he is expected to hear a series of pre-trial mbtions before then.
