Ruling ‘advances law’

PA Palmerston North The quashing of a murder conviction against a Foxton youth, Darrell Patai Wilson, aged 17, would advance the law, said his counsel, Mr T. A. de Cleene, yesterday. A retrial has been ordered for Wilson, who had been sentenced by Mr Justice Quilliam to life imprisonment. Mr de Cleene, who appeared for Wilson, with Mr L. H. Atkins, said yesterday that the judgment would advance the law and sound a warning about methods used

by the police in obtaining statements from accused persons. ■ He believed this was a “milestone” in the Court’s constant anxiety that the police did not use oppressive methods of interrogation. “We cannot have third degree, and the Court obviously felt it whs too much that a boy of 17 be subject to 6Vz hours of questioning,” Mr de Cleene said. Yesterday’s judgment came two weeks after Mr de Cleene had lodged the appeal.
