New claim ordered in B.C.N.Z. case
PA Wellington The former National member of Parliament for Taupo, Mr Ramon John La Varis, a company director, who is suing the Broadcasting Corporation of New Zealand for 5275,000 damages for alleged defamation, must file an amended statement of claim within 30 days. An order to this effect was made by consent by Mr Justice White in the High Court at Wellington on Tuesday. Mr La Varis is suing in respect of a television news broadcast on January 14, 1979, in which a photograph of him was shown in the course of an item about police investigations into alleged corruption in the Trade and Industries Department involving the issue of import licences.
The B.C.N.Z. filed a motion to strike out Mr La Varis’s statement of claim on the ground that it was vexatious and disclosed no cause of action. In court yesterday, Mr J. T. Eichelbaum, Q.C., for the 8.C.N.Z., said that the plaintiff had filed a new statement of claim late on Monday afternoon. This contained some entirely new! factual allegations which the! defence had had no opportun-l ity as yet of investigating. I Mr Eichelbaum alleged! that the new statement of claim was also deficient. Mr J. Witten-Hannah, on behallf of Mr La Varis, said that he acknowledged, the pleading could be improved on, and was in agreement! with the consent order. I Mr G. Rowe appeared with Mr Eichelbaum. I
