Town Planning THE TOWN AND COUNTRY PLANNING ACT 1977 HEATHCOTE CDUNTY COUNCIL DISTRICT SCHEME REVIEW PUBLIC NOTICE OF VARIATIONS TO THE REVIEW DURING MID-1980 THE COUNCIL heard and considered objections to the publicly notified review of the District Scheme. Decisions on these objections were sent out in December, 1980. Some of these decisions involved amending the publicly notified review, while others, which the Council considers have or may have wider significance than indicated in the original objection, are to be implemented by introducing ten variations to the District Scheme. A summary of these ten variations is given in the schedule below. Full details of the variations may be inspected at the Heathcote County Council office. 66 Colombo Street, at any time when the above place is open to the public. Submissions and objections to each of the variations or to any part thereof may be made by any body or person affected or representing some relevant aspect of the public interest. Submissions and objections shall be in writing in Form C prescribed in the Schedule to the Town and Country Planning Regulations 1978 or to the like effect and shall be lodged at the office of the Council not later than April 30, 1981. Forms for submissions and objections (Form C) are available at the Council office. At a later date every submission and objection will be open for public inspection and any body or person who wishes to support or oppose any submission or objection will be entitled to do so. SCHEDULE VARIATION NO. 1— The creation of a Residential Hillslope zone to replace the Residential 1,2, 3 and 4 zone ordinances controlling development in residential areas on the hills. This variation does not extend any areas of residential zoning, but simply introduces controls on all development, including excavations, in those previously defined residential zones on the hills which remain in the district scheme following decisions on objections, in order to recognise the particular characteristics of hillslope land in the County. VARIATION NO. 2— , . . The addition to the Rural Zone of a special clause relating to Lyttelton Harbour Board land to allow it to be used (in accordance with conditions) as a container depot. The land is contained in C.T. 108/1192 Canterbury Registry and is located adjacent to the Tunnel Road and the Heathcote River. VARIATION NO. 3— , The introduction of a clause providing for “Home Occunations” (including crafts) in the Residential 1 Zone. Such activities will be a predominant use in the zone, but subject to a number of conditions to protect the amenities of the zone and to guard against nuisance. VARIATION NO. 4— , , This variation introduces new and expanded policies and ordinances relating to objects and places of historic, scientific or architectural interest or natural beauty. In addition, there are provisions for tree preservation. A full list of criteria for choosing items for the register is included as well as opportunities for the public and specialist organisations to participate in the process. VARIATION NO. 5— . L - . The control of development in the Commercial Service zone and an expansion of the landscaping requirements in that zone. The zone is situated on the corner of Port Hills Road and Curries Road. Development on each site shall be undertaken m accordance with an overall development plan ior the site which shall set out all relevant detail concerning the layout, siting and design of vehicular and pedestrian access, buildings, parking, landscape and open space provisions. VARIATION NO. 6— ' . Provision for the Valley Inn Tavern to be a predominant use in the Commercial 1 Zone The land is contained in C.T., 4C/1027 and 103/94 Canterbury Registry and situated on the corner ot Marsden and Flavell Streets, Heathcote.

VARIATION NO. 7— This variation makes a number of amendments to the industrial zoning and ordinances in the Scheme. The Industrial 1 and Industrial 3 zoning immediately west of the Tunnel Roacl is deleted and replaced by “Rural” zoning. The means of defining permitted uses in the Industrial 2 and 3 zones is revised, and an appendix is added which lists industries considered to be noxious or dangerous in relation to adjacent areas. With the deletion of the Industrial 1 zone above, the ordinances for this zone are also deleted since it was the only Industrial 1 zoning in the County. Consequently, the variation will re-name the Industrial 3 zone as Industrial 2, and the Industrial 2 zone as Industrial 1. VARIATION NO. 8— This variation is designed to help protect tne amenities in and around Ferrymead Historic Park. Wharves, and the operation of aircraft engines are to be deleted from the list of predominant uses m the zone, while caretaker and other staff housing, and clubrooms associated with the Ferrymead Trust are to be made conditional uses. The development clause relating to visual appearance and character has been re-written, and a further clause added regarding the protection of amenities. A new clause requiring buildings to be finished within a resonable time has also been added. deletions from the list of designations. The reason for most 1 of the deletions is that the land in question is privately owned or has been designated in error in the District Scheme Review.. VARIATION NO. 10— . . „ This variation comprises minor miscellaneous amendments which were not covered by decisions on objections to the District Scheme Review but which are necessary to maintain the consistency and coherency of the District Scheme. These amendments involve clarification of descnptive passages and policy statements, cprrection of errors, removal of duplication and minor amendments to policy statements and ordinances on the following subjects: Introduction, Protective Rural Zone Reserves and Recreation, Subdivision, Park* ing ’and Loading, Access, Advertising, Road Widening and Deviations, Interpretation, Accessory Buildings and Garages, Residential 1 Zone, Commercial 1 Zone, Service Station Zone.
