Loan man in court today

PA Wellington One of the central figures in the Marginal Lands Board loans affair, Mr James Fitzgerald, will make a voluntary appearance in the District Court at Wellington today. Mr Fitzgerald, a son-in-law of the Minister of Agriculture. (Mr Maclntyre), will appear in court in relation to a statutory declaration he made to the Lands Board about his and his wife’s assets.

The couple were required to declare their assets when they applied for loan money from the board to develop a Wellington farm property. Mr Fitzgerald was interviewed yesterday by the police who have been investigating the declaration as a result of a complaint by the

Director-General , of Lands (Mr N. S. Coad).' The . police have been investigating the matter for three weeks.

In a separate development, a Wellington High Court judge, Mr Justice HardieBoys, reserved decision when lawyers acting for the Fitzgeralds sought an interim injunction to halt the Commission of Inquiry which is investigating the granting of a

Lands Board loan to the Fitzgeralds. The Fitzgeralds’ counsel, Dr G. P. Barton and Mr A. D. MacKenzie, want the commission stopped so that the Fitzgeralds can take a further application to the High Court. The further application would seek an indefinite halt to the commission until the police investigation of the Fitzgeralds and any subsequent prosecution is over.
