Musgroves request for injunction withdrawn
An application for an injunction by 7 Musgrove Bros, Ltd, to restrain trade union and officials from instructing their members to withdraw their labour was dismissed by Mr Justice Cook in the High Court yesterday. Mr D. J. R. Holderness, for Musgroves, said he sought leave to withdraw the motion for an interim injunction filed on May 9. The circumstances under which it was issued no longer .applied. Mr B. McClelland, Q.C., on behalf of the unions, consented to the application and applied for costs. His Honour dismissed the motion for the interim injunction and reserved the question of costs. Musgroves had sought the injunction against the Labourers, Carpenters, Engineering and Clerical Workers’ Unions, and Messrs W. R. Cameron, L. G. Morel, R. A. Lowe and L. M. Burns.
The dispute between Musgroves and the unions arose
out of redundancy payments for workers who were laidoff and has since been settled.
