No report for DC10 maker

NZPA ■ Washington! The McDonnell Douglas I aircraft company, maker of : the DCIO, has not been, given a copy of the interim j report on last November’s Air New Zealand crash in Antarctica, a spokesman has said. Speaking in the company’s headquarters in St Louis, Missouri, the spokesman (Mr R. Jeffrey) declined to say whether the firm had asked the New Zealand Government for a copy. “I guess it is up to the I authors to distribute it as they see fit,” he said. “We simply don’t have a copy at this time.” I Copies were said to have been sent to “interested parties.” Observers in Washington believe that the company may not have been sent a copy because the report makes it clear that the aircraft was not in any way to blame for the crash. An Air New Zealand move for a court ruling that a $2 million damages claim arising from the crash should not be heard in the United States has been postponed until next month. The motion to dismiss the case was to have started in

| the Federal District Court in I Los Angeles on Tuesday,, but : Mr J. Thielen, the lawyer iwho lodged the original I claim on behalf of a. widow of a passenger on the flight, sought a postponement. The case had now been set down for April 7, Mr Thielen said. The airline asserts that courts in the United States have no jurisdiction in the case, because the ticket for the flight was bought in Australia. Lawyers for Air New Zealand say the case should be tried in either Australia or New Zealand. Mr Thielen said that disI missal of the case would be unconstitutional because it would deprive an American citizen of her legal rights and limit any damages award to “a ridiculous figure.” i Mr Thielen argues that the case can be heard in the. United States because Air New Zealand has a registered office in California. He filed the SUS2 million claim on behalf of Mrs Marlena Lies, whose husband was employed in Australia. She paid for the flight ticket as a seventh wedding anniversary present.
