On 7 and 11 October 1978 j .‘the Commerce Commission! gave public notice that it had J received a report from the Examiner of Commercial Practices on an application bx Marlowe Agencies for approval of an individual j resale price maintenance' arrangement relating to the H prices of Matchbox toys. In that public notice the ’Commission. inter alia, ‘’invited applications for party status to the proceedings. [Two such applications were (received, from the Combined) ■ State Unions and the New Zealand Toy Retailers’ Federa lion. 3. On 11 October 1978 the ) i Commission received Marlowe ’[Agencies’ reply to the, ’’Examiners report. In this*. 1 reply Marlowe Agencies’ advised the Commission that | they accepted the Examiner s; /opinion, that they were pre pared to abandon forthwith the arrangement and that l thex wished to withdraw then application for approval of! I the arrangement. 4. The Commission con-1 sidered this reply. On 25 Octo-1 ; ber it wrote to Marloxve Agen i vies seeking assurances that ; the arrangement had been l , abandoned and would not be ; reintroduced without a fresh application for approval.
