NORTH CANTERBURY CATCHMENT BOARD AND REGIONAL WATER BOARD WATER AND SOIL CONSERVATION ACT 1967 PURSUANT to Section 24 (10) of the above Act NOTICE IS HEREBY GIVEN of the undermentioned decisions of the North Canterbury Catchment Board, as Regional Water Board, on applications for grants of rights under the Act. Where the decision is to grant rights the grant is subject to conditions normally imposed in grants of such nature. Where special conditions apply this is indicated. Button to dam a spring fed watercourse and to take water for spray irrigation. Costs: left where they fall. Water Rights Granted: Hurunui County Council and E. J. Upritchard. (i) the right to dam Eastern Outlet Drain and divert a flow of up to 5.5, cubic metres of floodwater per second in a grassed waterway around the eastern and southern perimeter of Amberley Swamp to a point near the junction of Watties and Stanton Roads. (ii) to discharge up to 1.4 cubic metres of water per second from the grassed waterway to Stanton Road Drairi and to discharge the balance of the water diverted by spillage into Amberley Swamp on the property of Mr E. J. Upritchard. (iii) to dam Eastern Outlet Drain by means of a control structure and to discharge up to 100 litres per second down Eastern Outlet Drain.

(iv) to dam Dock Creek and Stanton Road Drain outlet by means of existing weirs on Dock Creek and Stanton Road Drain outlet with drop structure to the Kowal River, to discharge 100 litres per second down Dock Creek and the balance of Dock Creek flood flows and the flow in Stanton Road Drain to the Kowal River. Rights expire 1988. Purpose of rights: to relieve flooding in Amberley Township. SPECIAL CONDITIONS: 1. That prior to the exercise of any of the rights hereinbefore referred to the Hurunui County Council as cograntee shall carry out the clearing, regrading and improvement of Stanton Road Drain in accordance with a design to be prepared and supervised by the North Canterbury Catchment Board; the said Hurunui County Council thereafter undertaking the maintenance of that drain from and including the point of discharge into Stanton Road Drain and downstream. 2. That the grantee shall forthwith and in any event not later than 6 months from the grant of these rights formally request the North Canterbury Catchment Board to prepare design plans for a flood relief scheme for Amberley Township and environs for the implementation of which the aforesaid rights have been granted. 3. The aforesaid rights shall be exercised jointly to the intent and effect of implementing the aforementioned flood relief scheme and in the event of cancellation of any of the rights so granted all of the said rights shall ipso facto be cancelled. 4. All works to be undertaken for the purpose of the above rights shall be undertaken to the satisfaction of the Chief Engineer of the North Canterbury Catchment Board. Objections: Not sustained. Application declined: Hurunui County Council and E. J. Unritchard, to discharge up to 2 cumsecs of drainage water from Amberley Swamp east of Stanton Road by a pipe under Stanton Road to an existing internal drain on the property of R. and B. H.
