Move to ‘bind’ Crown
Legislation should be changed to force effective Government compliance with the Water and Soil Conservation Act, said the Christchurch Drainage Board.
Board members have been troubled about water pollu- [ tion from the New Zealand! Railways’ Addington Work-1 shops. However, prosecutions against the Railways Depart-; ment would probably not! succeed because the Crown [ cannot be bound effectively: by local regulations. “We should bring pressure to bear, even if we cannot get criminal liability,” said Mr R. S. Leach. “In this action, we may not go directly' to the target, but it will at least get us on out wav.”
At an earlier meeting, i board members said they j should at least embarrass Government polluters, even; if they could not get fines’ against them in court. “The Crown initiates these laws, then is not responsible under them,” said Mr C. H Russell. “We should see that it has the same responsibilities as others.’’
