Court move on behalf of JBL
PA Auckland A notice of motion seeking an order to compel the Government receiver (Mr D. L. Hazard) to take action on behalf of JBL Consolidated, Ltd, against the A.N.Z. Bank and the company receiver (Mr R. Dwyer) has been filed in the Supreme Court at Auckland. The motion was filed on behalf of James Edward Jeffs by his lawyers. The application alternatively seeks an order to authorise Mr Jeffs to take the action.
Last year, Mr Jeffs issued a writ suing the bank and Mr Dwyer. It alleges they acted negligently, dishonestly, or recklessly In ap« pointing a receiver and in his subsequent actions.
Mr Jeffs’s solicitor said that if the action was not taken before May 23 the company might be legally out of time.
