Harley and Lodge cases adjourned
Petitions for the winding up of Harley Chambers, Ltd, and Lodge Inns, Ltd, were both adjourned to dates in May by Mr Justice Roper in the Supreme Court yesterday. Mr G. S. Brockett, counsel for both companies, applied for a further adjournment to May 3 for the Harley Chambers petition because of the company’s ties with Lodge Inns.
Lodge Inns leased the Lodge Hotel at Hanmer Springs until it went into receivership on April 4. The lease, which was sold by the receiver on the same day to an Auckland firm, is the subject of an interim injunction sought in the Supreme Court on Tuesday. The hearing of this injunction to stop the sale of the lease has been adjourned to April 20.
Mr Brockett said that the principal shareholder of both Lodge Inns and Harley Chambers, Mr J. A Hanna, had arranged finance through an Auckland firm to allow his debts to be settled.
However, the lender of the money had informed him on Friday that because of the link with Lodge Inns, he was not prepared to tender the money until the business before the Court over The Lodge was completed. He felt he might have to pay up more to protect the securities, Mr Brockett said. The petition to wind up Lodge Inns, which was adjourned to May 10, was filed by Basil A. Fitzpatrick and Company, Ltd, a Rangiora wine and spirit merchant. The petition to wind up Harley Chambers was filed by Quill Morris, Ltd, which has since been joined by six other creditors — R. K. Boyd and Company, Ltd; Interbuild Holdings. Ltd; Victor Garth Preen; Fletcher Merchants, Ltd; Fletcher Timber, Ltd; and Waitahi [Developments, Ltd.
