Jones case

PA Wellington A Supreme Court jury in Wellington last evening awarded the property investor, Robert Jones, damages of $4OOO for unlawful detention by a traffic officer, Kenneth McLeod. Mr McLeod in turn was awarded $2500 damages for defamation by Mr Jones in a Radio Windy talk-back session after the incident in which he had been detained. Mr McLeod had claimed $32,000 and Mr Jones's counter-claim was for $15,000.

Before the jury retired, Mr Justice Ongley ruled that Mr McLeod had no lawful justification for detaining Mr Jones after he had been stopped on his way to the radio station.

Remarks Mr Jones subsequently made about Mr McLeod on the radio programme were capable of conveying a defamatory meaning, but the jury had to decide if they were in fact defamatory, said his Honour.
