Rehearing for councillor
PA ' Auckland I Mr Justice Speight has i ordered a rehearing of the case against an Auckland City councillor convicted and fined $25 for peeping and peering. Kenneth Sydney Dobson, an electrician, had appealed to the Supreme Court at Auckland against conviction ion a charge of being found by night without lawful exIcuse peeping and peering ! into a Glendene house on January 28.
He was convicted and fined in March Counsel for Dobson, Mr G. F. I.ittle, said the Magistrate
had misdirected himself on an admission by the appellant that he had been at the property. His Honour said he agreed that did not appear to be sustainable. He said the man over the road from the complainant had taken the number of the Holden station waggon but that had not been given in evidence.
He said there were one or two unsatisfactory features in the evidence. Certain conclusions showed it was a proper conviction, but certain other things showed it was a proper case for a rehearing in the Supreme Court.
