Unusual bail terms
I A special condition of bail (for Darryl Ivor Wheeler, charged .with rape, assaulting a woman, and wilful damage, was that he was not to associate with his (mother, his stepfather, or his two sisters during the period of the remand, Mr B. A. Palmer, S.M., said in the Magistrate’s Court yesterday. This was an unusual condition of bail but it was necessary in this case, he said. Wheeler, aged 21, appeared in Court yesterday on charges of assaulting Mrs Yvonne Sampson and wilfully damaging a window last Monday. He was on bail on a charge of rape when the alleged offences took place. Counsel (.Mr D. Maze) said that Wheeler would be appearing in Court again on May 10 for the taking of depositions on a charge of rape. He sought a remand to that date on bail. The application for bail was opposed by Sergeant B. G. Saunders.
After a hearing in chambers, the Magistrate said, that he would grant Wheeler bail of $3OO until May 10 in respect of the assault and; wilful damage charges, but,; (in view of certain other; 'matters mentioned in cham-j bers, a special condition; ■would be that he did not associate with members of; his family. More specifically, this ( meant that Wheeler was not, to make any contact with) (his mother, his stepfather,! his sister (Mrs Sampson): and his other sister, during the period of the remand, he said. On the charge of rape, the Magistrate said, he was pre-,’ pared to grant Wheeler bail, 1 providing he was able to find two acceptable sureties ' of $5OO each. “Your sister. Mrs Samp-J (son, cannot be an accept-J able surety any longer as she is aged 16, and a person J is ineligible as a surety I unless they are at least 20,”|l he said. : Wheeler was ordered to be s kept in custody until two acceptable sureties had been < found. 1
