Rhodesian abductions illegal-judge

A Bulawayo judge has ruled that his court has no jurisdiction over two Botswana men brought across I the border by Rhodesian [forces to face arms charges [because, he said, it meant condoning the illegal abducItion of Botswana nationals.
Legal sources said that the court hearing had no precedent in Rhodesian law. ] A former Chief Justice, Sir Hugh . Beadle, sitting as president of a special court used to try suspected guerrillas, ruled: “This Court must hold it has no jurisdiction to hear the case. Were it not so it would mean this Court condoned the illegal abduction of Botswana nationals who, at no material time, were residents in or present in Rhodesia.” Sir Hugh referred the case to the Appeal Court for im- : mediate consideration be-
cause of its public importance and legal complexity.
The two accused were not asked to plead. Botswana has frequently accused neighbouring Rhodesia of border violations, including taking Botswana citizens across the border. Rhodesia has not admitted the charges.
