A jury in the Supreme!' Court has awarded Allister ] ' Douglas Monk, aged 59, a ] storeman, total damages of j $7BOO for a back injury he : suffered when unloading a 1 machine from a van on ' December 20, 1972. Mr Justice Roper, who pre- i sided over the trial, has not < entered judgment for Mr 1 Monk for that amount, but 1 adjourned the matter for i further consideration because i the amount awarded by the > jury was less than that paid!! into Court. Willy and C. M. Marshall, claimed general damages of $20,000 and special damages of $3OOO from Mace Engineering. Ltd, which denied liability. Mr C. B. Atkinson appeared for the defendant company. Evidence was given that Mr Monk suffered the back injury when he was unloading a final-drive unit, which weighed about 2501 b, at the Hagley Auto Service Station in Victoria Street. His foot slipped on the floor and he wrenched his back, which I had to be operated on. | The jury found that Mr I Monk was 40 per cent liable I for the accident.
