Insurance firm asked to pay
KZPA Bangkok Thailand’s Court of Appeals has asked the New Zealand Insurance Company to pay a million baht (about 5NZ54.000) in compensation claimed by a police lieutenant acquitted earlier on charges of blowing up a Cathay Pacific jetliner in 1972 The court overruled an earlier verdict of the civil court to dismiss a claim by Somchai Shaiyasut for insurance he took out on his gir j friend, who died in the jeexplosion Somchai was arrested in Aitgust. 1972. and charged with premeditated murder, destruction of property, toggery. and possession cf explosives He was acquitted for lack of concrete evidence rhat he planted a bomb in a cosmetics case he gave his girl friend. Somwang Prompin. to take aboard the plane. The plane blew up 29,000 ft ower the central highlands of South Vietnam on June 15, 1902. killing all 81 persons aboard, including the girl and Somchai’s seven-year-old daughter, who were travelling to Hong Kong. The insurance company contended that the crash was a result of sabotage and occurred in a war zone, and that therefore it should not be held responsible for compersation for the girl’s death.
The Court of Appeals said that the insurance pohcv was valid and that the company
must, pay compensation. The company also wa? ordered to pav Somchai 7.1 per cent in interest retro
spective to August 25, 1972, plus a court tee of 20,000 baht (about SAust9so). The company is expected to contest the case in the Supreme Court soon. Somchai won in the civil court last December a claim of 5U532.000 as compensation from the Hanover Insurance Company for the deaths of Somwang Prompin and his daughter.
