'Bikie’ law tightened
PA Wellington The Government has tightened its “bikie” legislation, to ensure that if a court decides that a person should not own a motor-cycle for 12 months, it has the power to enforce this. Amendments to the Criminal Justice Amendment (No. 2) Bill now provide that if a person — fearing that a court may make an order confiscating his vehicle — sells the vehicle between the time of being charged and conviction, the court may make an order prohibiting ownership of a vehicle for up to 12 months. A further amendment provides for publicity to be given to the confiscation of a vehicle (the definition in-
eludes a motor-cycle), so that people holding a financial interest in it may take action Tto secure their investment. The bill takes new account 11 of newspapers or magazines publishing details about how to make a bomb or incendiary device. The amendments make it a defence to argue that the details were published with no (harm intended, according to the chairman of the Statistics Revision Committee, Mr I. K. McLay (Nat., Birkenhead). It is also a defence to argue that the publication in which the details were printed was one of a techni■ca! nature. Mr R. W. Prebble (Lab., Auckland Central) said th? Law Society had argued that ■the law could be circum-
t (Vented. “And when criminals i- discover the law can be cirn ;cumvented, there will be less (respect for the law.” it! He argued that the meas sure should be referred back vjto the committee for study j-(during the Parliamentary re- ■ cess. The police and the a [courts had not been given -[new powers, he said. o! The amended Police Of(fences Amendment Bill now 1 makes it a defence for a perriso.i found carrying an offens- . jive weapon on private prop- ■> erty to prove he had no ini tention of using it. c Dr A. M. Finlay (Lab.. Hen- - derson) said that despite the amendment the legislation ~ was still “debatable.” » He foresaw a considerable t area of defence which could -(defeat the objects of the bill.
