Injunction laid on Radio N.Z.

PA Auckland Mr Justice Mahon has granted an ex parte interim injunction restraining Radio New Zealand from broadcasting the results or any part of the latest “New Zealand Herald” National Research Bureau surveys of political opinion. A notice of motion, claiming breach of copyright, was filed by Mr J. G. Miles on behalf of Wilson and Horton, Ltd, publishers of the “Herald,” in the Supreme Court at Auckland yesterday. The injunction applies to surveys of the popular standing of the political parties (published in the “Herald” and “The Press” yesterday), the ratings of

prominent politicians (published today), and the public’s assessment of key issues (to be published tomorrow).

A writ seeking an injunction and claiming $20,000 in aggravated damages from Radio New Zealand is before the Court.

It was filed by Wilson and Horton, Ltd, on March 23 and alleges breaches of copyright during 1974 and 1975 in the unauthorised broadcasting of “Herald”N.R.B. surveys. The surveys, it is claimed, constitute original literary works in which the “Herald” owns the copyright for its own use and for the assignment to other newspapers.
