Fen dalton on Wednesday, July 21, 1976, passed the following resolution: "That in pursuance and ex I ercise of the powers vested tn it by the Counties Act 19ac and the Local Authorities Loans Act 1956 and amend ments thereto, and all othei Acts (if any) enabling it in that behalf, and by virtue ol the sanction of the Local Authorities Loans Board gran ted at a meeting of the Board, held on June 29, 1976 the Waimairi County Council i hereby resolves to proceed to' raise in New Zealand a loan to be known as Housing lot I the Elderly (Breens Road) Loan 1976 of an amount oi one hundred and twenty-six! thousand dollars 1*126,000) lot the purpose of erecting 36 flats for the housing of the elderly (Breens Road) subject to the following determinations: ■ 1. That the loan be known as Housing for the Elderly (Breens Road) Loan 1976 and hereinafter referred to as the said loan. 2. The term for which the said loan or any part thereof may be borrowed shall be 30 years. 3. The rate of interest that may be paid in respect of the said loan or any part thereof) shall be such as shall not pro duce to the lender or lenders a rate or rates exceeding 3.51 per cent per annum. 4. The said loan or any) part thereof, together with the Interest thereon, shall be repaid by equal aggregate annual or half-yearly insial ments extending oxer the term as determined in clause 2 hereof. 5. The payment of all such Instalments shall be made in New Zealand and no such instalment shall be paid out of loan money. 6. Such further conditions that tnay be stipulated by the Mortgage Loans Commit tee of the Housing Corpora tlon of New Zealand. 7. That the security for the! repayment of the said loan and the charges thereon shall be a special rate of 0 00260 cents in the $ (dollar) on the capital value of all rateable property in the County of Waimairi."
