Attempt to stop hotel

Legal processes seeking to prevent the building of the Arlington Motor Inn, a slm project, were initiated yesterday on behalf of five persons who live near the site in Park Terrace.

An application for a writ of mandamus, demanding that the City Council appear in the Supreme Court to show that the building permit for the Arlington Motor Inn was issued according to the regulations, was filed in the Supreme Court yesterday and served on the Town Clerk (Mr M. B. Hayes).

“I have been served with a legal process in connection with the Arlington Motor Inn building and it will be referred to the City Solicitor,” Mr Hayes said yesterday. The application also seeks a final injunction to prevent Arlington Motor Inn, Ltd, proceeding with the project. The application has also been served at the registered office of the company. Two solicitors are the nominal directors of the company which has a nominal capital of $200,000. The company is named as second defendant in the action sought The company, in October of last year, announced that it would build an accommodation house of 100 rooms in Park Terrace to cater for more than 200 guests. ent hotel interests in both the North and South Islands. The company sought no Government financial assistance. A contract to build the inn was let this year and houses on the site of three-quarters of an acre with frontages to Park Terrace and Peterborough Street have been demolished in the last few weeks. Excavation work for the building had been done and a start made on the foundations.
