Sentence varied
Because of police regulations, Mr Justice Wilson varied in the Supreme Court yesterday a deferred sentence he had imposed on David John Smart, aged 22, a painter. On Friday Smart was ordered to come up for sentence within three years if called up on charges of burglary, unlawfully taking a car, and driving while disqualified. He was also ordered to live at the home of a temporary constable who had befriended him, to undergo psychiatric treatment, and to pay restitution of $2415 at $2O a week for damage he caused to the car he had unlawfully taken when it rolled over.
His Honour said yester day that it was necessary fo the sentence he imposed 01 Smart on Friday to be variec because of police regulation: which precluded the con stable from having Smart a: a boarder at his home.
