Conviction quashed
An appeal by Glenis May Shearer, married, of Harihari, against a conviction in the Magistrate’s Court on a charge of making a false declaration under the Customs Act was upheld by Mr Justice Wilson after an appeal by way of rehearing in the Supreme Court yesterday. The conviction was quashed. Mr N. W. Williamson appeared for the Crown and Messrs P. T. Mahon, Q.C., and A. J. Forbes for the appellant. Earlier this year in the Magistrate’s Court the appellant was fined $l5O and was ordered to pay a solicitor’s fee of $3O on a charge that, with intent to defraud the revenue of the Customs Department by evading duty on a Mercedes Benz car, she made an erroneous declaration that she had personally oymed the car for at least a year before shipment to New Zealand. The magistrate also ordered forfeiture of the car. The appellant had pleaded not guilty to the charge.
