INJUNCTION ACTION
Interim order made An interim injunction, pending a further order of the Court, was granted by Mr Justice Macarthur in the Supreme Court yesterday restraining Stuart Willetts, manufacturer and merchant, from carrying on business as a cordial manufacturer under the trade name of Kaban.
Mr A. D. Holland appeared for the plaintiff and Messrs J. G. Leggat and N. D. Thomson for the defendant. His Honour upheld a submission by Mr Leggat that the plaintiff should undertake to pay any damages which the defendant might suffer from the granting of the interim injunction if the plaintiff did not succeed in the action which is still to come before the Court He was satisfied that the labels used by the defendant amounted to a passing-off, said his Honour. When the plaintiff threatened action the defendant promptly altered the labels, but the change was inadequate.
