MAGISTRATE’S COURT Four gaoled for year for $64 robbery

Four young soldiers who had previously pleaded guilty and been convicted on a charge of robbing a fish-shop proprietor of $64 on November 28 were sent to prison for one year by Mr P. L. Molineaux, S.M., in the Magistrate’s Court yesterday. The defendants, Noel Avijson, aged 20, Denis James Windle, aged 18, Murray Kenneth Reece, aged 18, and Lance Wesley Hunniford, aged 19, were members of the Ist Battalion, Burnham Military Camp. They were represented by Mr E. T. Higgins. The Magistrate said that notwithstanding the offenders’ age and the fact that they had never before been before the Court, the offence called for imprisonment. An innocent member of the public had been beaten up and robbed.

“In my opinion the Court is required to deal out to you a sentence which will give a measure of protection to shop owners and others who work at night without physical protection,” he said. Hunniford and Reece had beaten up the proprietor while the others had made off with the cash register from the shop. Hunniford and Reece were each convicted and discharged on a charge of . assaulting John Peter Boag in the fish-shop on the same date. They were disqualified from driving for one year from the completion of their prison sentence, and ordered to pay restitution of $12.50 on a charge of .unlawfully

taking a car at Taihape on or about September 4.

Raymond Michael Spriggs, aged 20, a soldier (Mr Higgins), a co-offender in taking the car, was fined $l5O, disqualified from driving for one year, and ordered to pay restitution of $12.50. He had previously pleaded guilty and been convicted. Mr Higgins said it was quite obvious the defendants had all been drinking heavily before the offences. Liquor had dulled their sense of right and wrong. The robbery was decided on after a very short discussion. . The four offenders bitterly regretted the, incident, in which they would have had no part had it not been for liquor. SIX MONTHS GAOL “You have an extensive list of previous convictions inducting theft, burglary and fraud,” said the Magistrate before sentendng Kenneth Shane Stevens, aged 23, to six months imprisonment. The Magistrate said that Stevens had abused his opportunities and was serving a period of periodic detention imposed in September. Stevens was appearing for sentence on six charges of false pretences and one change of credit by fraud. The charges related to goods and cash obtained with valueless cheques to a total of ¥78.34. REMANDED Murray Graham Dick, aged 17, an unemployed labourer (Mr J. E. Butler), was again remanded, until December 9, for a medical examination as to his suitability for . periodic detention. He appeared for sentence on a charge of unlawfully taking a car. The Magistrate said the defendant was arrested in Blenheim in the stolen car valued st *359. I Robert John Cudby, aged 23, an unemployed labourer (Mr J. E. Butler), was arrested In the stolen car taken by Dick, said the Magistrate. “He seems to think society makes too many demands on him, but society makes no demand on him at all,” said the Magistrate, before remanding Cudby to December 9 for a medical examination as to his suitability for periodic detention.

Counsel said that Cudby had difficulties in adjusting to the demands of society and the offence had been committed while he was under the influence of alcohol Cudby had been unable to obtain work, was antagonistic towards society and had too many convictions for his age. ASSAULT Bruce Paruhlteterangl Temonl, aged 22, a locomotive, trainee, was fined $5O on two charges of assault. He pleaded guilty. The defendant was arguing with his girl friend outside the complainant’s house at 12.30 a.m. on December 6, said Senior-Ser-geant F. G. Mulcare. The complainant thought the girl was in distress and intervened. Temont hit him in the face, cutting his lip. The complainant called his father and he too, was struck in the face, his eye being cut The defendant said there was a misunderstanding and he had only pushed both the complainants away. FIGHTING The three defendants fought with youths in New Brighton on Saturday afternoon while police were attempting to question them about an earlier fight, Senior-Sergeant Mulcare said when Raymond Tutwhereiko Leevey. aged 23, a slaughterman, Paul Mariu, aged 21, a freezing worker, and Bill Tamalra, aged 23, a cable worker, all appeared on charges of fighting in Beresford Street. All pleaded guilty and were convicted and fined *3O each.

Senior-Sergeant Mulcare said the fighting occurred about 5.15 p.m. on Saturday. Leevey said there were 15 youths and only the three defendants The youths had picked on one of them and the others had gone to his assistance. SHOP THEFTS A woman, whose name was suppressed, was fined *3O on two charges of theft. She pleaded guilty and was represented by Mr H. J. B. Quigley. A shop detective in Beatb and Company on October 19 saw the defendant put two pairs of pantyhose under her coat and leave the shop without paying for them, said Senior-Sergeant Mulcare. Articles valued at *11.28 including socks, handkerchiefs, pantyhose and men’s pyjamas were found in the defendant’s possession. These had not been paid for. said Senior-Sergeant Mulcare. The socks were found to belong to the D.I.C. Counsel said that the defendant had suffered severe shock after the death of her brother. The articles stolen were not required nor was she short of money. It was unlikely that she would come before the Court again and he asked for suppression of name. NAVY-BASE THEFT Pita Tauwhare, aged 40, a freezing worker, was convicted and remanded in custody to December 14 for sentence when he pleaded guilty to a charge of burglary of a barracks at the United States Navy Base at Harewood. Senior-Sergeant Mulcare said the defendant was found inside the barracks attempting to remove a television set valued at *l7O. When apprehended by an officer be drove away in his car, but was later arrested. He had previous convictions. STOLE TYPEWRITERS Frederick Charles Mlles, aged 34, unemployed, pleaded guilty to charges of stealing a typewriter worth *9O from the Christchurch Drainage Board office on October 20, and stealing a typewriter worth *B5 from the Post Office on November 3. He was convicted and remanded in custody to December 14 for sentence. Senior-Sergeant Mulcare said the defendant was interviewed on November 30 after the typewriters had been traced to second-hand dealers. He told the police he stole them to sell because he wanted money. DISORDERLY On a charge of being idle and disorderly in that she had insufficient lawful means of support at Lyttelton on December 8, EUlnore Elizabeth Abraham, aged 19, an unemployed waitress, was convicted and remanded on bail to December 14 for sentende. She pleaded guilty. Senior-Sergeant Mulcare said the defendant was arrested on Cashlh Quay at 8.30 a.m. She said she had just arrived from Wellington and intended to spend the week-end on board a ship with her boy-friend. She had no money and had been unemployed for some weeks.

ESCAPING CHARGE Ronald Arthur Finlay, aged 20, was remanded In custody to December 14 on a charge of escaping from Tongariro Prison on March 24. No plea was taken. ' (Before Mr H. J. Evans, S.M.) DISQUALIFIED DRIVER Stephen Geoffrey Rea, aged 25, a barman, was ordered to pay court costs of *5 and was disqualified from driving for 12 months when he appeared on a charge of driving while disqualified at Lyttelton on October 23. He pleaded not guilty. For the defendant, Mr A. P. C. Tipping said it was admitted that the defendant had driven, but his defence was that he did not know he had been disqualified for a previous offence. He thought he had been fined only. The Magistrate ordered that the disqualification period he had Imposed run concurrently with the defendant’s previous threeyear disqualification. FINED *25 Hugh Vincent Flack, aged 50, u builder, was fined $25 and disqualified from driving for three months when he was convicted on a charge of falling to stop at a stop sign at Lyttelton on October 30, 1969.
