SUPREME COURT Claim struck out
An order was made by Mr Justice Macarthur in the Supreme Court yesterday striking out proceedings brought by Charles Emery Louis Field, a radio dealer, against J, D. Kinder, a stipendiary magistrate, when Mr Field failed to appear and was not represented by counsel. Mr Field was ordered to pay costs of $3O. The claim was struck out on the application of Mr N. W. Williamson, who appeared for Mr Kinder. There was no basis for the proceedings, Mr Williamson said. It was claimed by Mr Field that Mr Kinder had no jurisdiction to deal with proceedings which had been brought by Mr Field, even though the Magistrate had ruled in his favour.
