Hotel case decision

(N.Z. Press Association) WELLINGTON, Oct. 15.

A motion by a hotel manager and his wife to dismiss injunction proceedings brought against them by their employer was dismissed by Mr Justice Roper in an oral judgment delivered in the Supreme Court today. Maurice Sidney Garvie and Vivienne Mary Garvie are named as defendants.

The plaintiff, New Zealand Breweries, Ltd, sought an injunction to restrain the defendants from remaining in the manager’s quarters of the Cambridge Hotel. The plaintiff’s motion for injunction should be heard without delay, and the parties could be assured of the court’s co-operation to that end, he said. Mr C. J. Tobin appeared for the plaintiff, and Mr M. A. Bungay for Mr and Mrs Garvie.
