MAGISTRATES COURT Two Youths Sent To Borstal On Seven Charges Of Burglary

Two youths were sent to Borstal on seven charges of burglary and two of unlawfully taking motor-vehicles after Mr P. L. Molineaux, S.M., had called their activities “a disgraceful performance” in the Magistrate’s Court yesterday. Appearing for sentence were Thomas Alexander McPherson, aged 19, and Arthur James David Wederell, aged 18, both unemployed. Neither was represented. . The two had taken a truck from Invercargill on July 7 and driven north, the Magistrate said. It had run out of petrol near Balclutha and they had then taken a car. They had left this north of Dunedin and hitch-hiked to Christchurch. Once there they bad burgled seven shops. The Magistrate noted that Wederell had been released on probation for burglary in April and had earlier been sent to Borstal. McPherson had also been released from Borstal earlier in the year. There seemed little difference between their oast activities. They had planned to use the money gained from their burglaries to go to Australia. The defendants, who also appeared on charges of being idle and disorderly, were each ordered to pay $242.52 as restitution.

David Tomlins, aged 2). a plastic moulder, pleaded guilty to the charges of wilfully damaging a cup board door, assaulting Constable Te Kangl Matanuku Kaa assaulting Keri John Tomlins and assaulting Carol Balloch Tomlins on July 17. Special conditions of the defendant's ball are that he not reside at the address where the offences were committed, and that he undergo a psychiatric examination during the period of the remand. Senior-Sergeant F. G. Mulcare said Constable Kaa saw the defendant with an axe tn hie hand inside a house when he was called to an address In Kowhai Street about 6.10 p.m. The defendant threatened to attack the constable with the axe if he entered the house, but the constable managed to taki the axe from him.

He was con victed and remanded on ball to July 27 for sentence. Senior-Sergeant Mulcare said the offences were committed by the defendant when he was asked by salesmen of General Foods, Ltd, to obtain cartons of food for them. On each occasion they shared the profit with him The food lines stolen were chickens, meat, frozen vegetables and ice cream. The amount of restitution sought by the police totalled 894.50. The defendant admitted the offences when interviewed by the police. He said he had been unable to refuse the salesmen when they asked him to take the food for them. JOINT CHARGES

Adrien Ross Jones, aged 22. an unemployed workman, and Tul William Byron Roberts, aged 16. an unemployed workman, were convicted and remanded in custody to July 27 for sentence when they pleaded guilty to 10 joint charges of burglary. The offences were committed at Christchurch. Washdyke. Dunedin and Timaru between July 3 and July ». The premises broken Into were shops, service stations and food markets. INDECENT ASSAULT A man whose name was supS reseed was 1 remanded until uly 27 on a charge of Indecently assaulting a girl aged 13. His counsel, Mr K. N. Hampton, said that the. defendant had probably been under an epileptic seizure at the time of the offence. The defendant pleaded guilty. JOINT THEFT CHARGE Ross Alexander Campbell, aged 24, a farmhand (Mr G. K. Panckhurst). and George Here, mala, aged 20, a millhand, pleaded guilty to a joint charge of theft. Campbell pleaded not guilty to a charge of using obscene language at Hororata. Campbell was remanded tn custody and Heremala on ball to July 27 for orobatlon reports and sentences. Senior-Sergeant Mulcare said that Campbell used the obscene language at Hororata on July 5 when being interviewed by the ooilce concerning an alleged theft. A complaint had been received from two persons that household items. Including a radio and bagpipes, had been stolen from their house In Glentunnel during a party. Articles valued at *440 were found In the defendant's car. They admitted the theft. REMANDED IN CUSTODY Richard Stephen Hall, aged 17. a builder's labourer, was remanded In custody until Wednesday when he appeared for sentence on two charges of burglary, one of unlawfully interfering with a motor-car and one of driving while disqualified. The remand was requested by Hall’s counsel. Mr E. T. Higgins, for further consultation. Ball was refused after the Magistrate said that Hall had undergone detention centre training recently for theft and carrying an offensive weapon. IDLE AND DISORDERLY Jeffrey James Katene. aged 18, and Vivian Paul King, aged 19. both unemployed, pleaded guilty to a charge of being idle and disorderly on July 11. Katene, who previously gave his name as Tainul, was convicted and fined *3O. King was convicted and ordered to come up for sentence if called upon within 12 months. The Magistrate said that whereas King had responded to the directions of the Maori Welfare Officer and stayed In a iob. Katene had failed to respond when given the same opportunities.
