JUDGMENT IN TAX CASES
(New Zealand Press Association) WELLINGTON, May 8. The Supreme Court judgment of Mr Justice McGregor on the s9m Europa Oil and Associated Motorists Petrol Company, Ltd, tax case was handed down today.
In a 17-day hearing, which began on February 17 and concluded on April 2, the two companies appealed against income tax assessments covering the period 1959 to 1965. In the Europa case his
Honour found for the Commissioner of Inland Revenue, but in the Associated Motorists case he found for the objector.
During the hearing counsel for the objectors, Mr P. T. Mahon, had claimed that if judgment went against his clients up to s9m could be involved. Of this, is was believed, about ssm would have been on behalf of Europe and s4m on behalf of Associated Motorists.
However, in his judgment, his Honour said no arguments had been addressed to him in relation to the quantum of the assessments. In view of this he had not discussed such matters and they were, if necessary, reserved. Mr Mahon, with him Mr R. F. Pethig, appeared for the objecting companies, and the Solicitor-General (Mr J. C. White, Q.C.), with him Mr I. L. M. Richardson and Mr G. Cain, for the commissioner.
