MAGISTRATE’S COURT Men Admit Assault On Proprietor Of Hotel

This was a particularly vicious assault on the proprietor of the hotel and has made him incapable of work for about six weeks, said Senior-Sergeant F. G. Mulcare, in the Magistrate’s Court yesterday when two men appeared on charges of assault.

Michael Eddy Pomana. aged 25, a labourer, pleaded guilty to a charge of assaulting Edward Albert Smith with intent to injure. Edward Bloomfield Munro, aged 25, a labourer, pleaded guilty to assaulting Mr Smith. They were remanded on bail to December 23 for sentence by Mr E. S. J. Crutchley, S.M. About midday on Saturday, December 14, a group of Maoris were drinking in His Lordships Hotel. When they left it was found three glasses were missing. The proprietor, Mr Smith, approached the group and asked them if they had the glasses. Two glasses were produced and they were placed on the office shelf, said Senior-Sergeant Mulcare.

Mr Smith was informed that there was another glass missing and he again approached the group. He asked Munro if he had the glass and an argument developed. Munro pushed Mr Smith and at the same time Pomana tackled him from behind. When Pomana punched Mr Smith twice in the head Mr Smith fell to the footpath and suffered severe injuries. While he was lying on the ground he was kicked in the head and knocked semiunconscious.

The group got into a car and drove off along Lichfield Street, but Mr Smith took the number, Senior-Sergeant Muicare said. Mr Smith was taken to the Christchurch Hospital and was found to be suffering from two fractures of the right arm, cuts about the head which required several stitches, and had a punctured ear which was bleeding profusely. When Pomana was interviewed he admitted tackling Mr Smith and punching him twice on the head, and Munro admitted pushing him on the shoulder. Inquiries were still being made for the person who kicked Mr Smith in the head. Both accused had previous convictions. Senior-Ser-geant Mulcare said. BURGLARY ADMITTED

Owen Leslie Pugh, aged 46, a labourer (Mr D. M. Palmer), and Morris Frederick Barr, aged 34, a glass sorter (Mr M. J. Glue), pleaded guilty to a charge of burglary of the tobacconist shop of Gilmore Clifford Woodham, 368 Riccarton Road. They were remanded on bail to December 23 for sentence.

Senior - Sergeant Mulcare said that about 11.15 p.m. on December 13 the front plate-glass window of Mr Woodham’s shop was smashed with a hammer and watches valued at 858.75 were taken. Two youths and a girl who heard the sound of smashing glass took the number of a car which drove away without its lights on. At first the two accused denied being involved in the offence, but later admitted it. Both accused had previous convictions.

The Magistrate said Steele had come close to being given some form of detention. FALSE PRETENCES Peter John Bennett, aged 18, an unemployed farmhand (Mr R. M. Wilkes), was remanded in custody to December 18 for sentence on three charges of false oretences and three of aiding in false pretences. He pleaded Iguilty to the charges which involved the presentation of valueless cheques. FAILED TO STOP When Kent william Vaux, aged 19. a concrete worker, went to .sleep while driving at Sockburn at 1.15 a.m. on October 20, he veered left and crashed into a parked car, which cannoned for- ! ward into another, causing a I $825 damage, said SeniorSergeant Mulcare. 1 The accused did not stop i after the accident, said the sen-ior-sergeant, but was found by police about two miles further ’on. Vaux admitted striking the car. and said he had fallen asleep but the collision had woken him up. He had seen noone in the car so had driven off, stopping to telephone his father who had told him to go to the police. He had then been arrested before he could do this. On a charge of falling to stop after an accident, Vaux was fined $4O and disqualified for three months. On a charge of driving carelessly he was fined $l5 and disqualified for three months. For failing to ascertain if any person was injured after the accident, he was ordered to pay costs only. The accused's counsel, Mrj !R. F. Boland, said the cost of i damage to the other cars had been met by Vaux. WILFUL DAMAGE Morris Joseph Kennedy, aged 21, a soldier, who threw a lemonade bottle through the windscreen of a car which had earlier beaten him to a parking space, was fined $25 on a charge of wilful damage and ordered to pay restitution. He pleaded guilty. The offence occurred about 11.45 p.m. on August 23. For Kennedy, Mr K. W. Hampton said he had been drinking and when the complainant. Mr T. Kahiu, had taken a parking space he was preparing to move into he had become annoyed. At a later stage he had thrown the bottle, smashing the windscreen, but there was no-one in the c»r at that time. drugs on November 15. Gary William Henham, aged 17, unemployed (Mr R. F. B. Perry), pleaded not guilty, was convicted and fined $5O and disqualified for three years. For driving without a licence he was fined $5 and disqualified for six months. He pleaded guilty to this charge. The charges were laid after an accident at the intersection at Bealey Avenue and Colombo Street. DISCHARGED Nine persons were discharged without conviction when they appeared for sentence on charges ranging from unlawful parking to the theft of a potato peeler valued at 25 cents. All had their names suppressed. In each case the detendants were discharged under Section 42 of the Criminal Justice Act, which empowers the Magistrate to dismiss a defendant without conviction. The matter of sentencing on the charges had been adjourned by the Magistrate for several months with a view to discharge, provided the defendants’ behaviour had been satisfactory in the meantime. The Magistrate told each defendant that the discharge was a rare indulgence which they would only be given once because of the special circumstances of their case.
