MAGISTRATES COURT Man Admits Charge Of Receiving Stolen Onions

On a charge of receiving 47 bags of onions worth $127, knowing them to have been stolen, Bernard Francis Basan, aged 41, unemployed, was convicted and remanded on bail to September 9 for sentence by Mr H. J. Evans, S.M., in the Magistrate’s Court yesterday. A complaint was made to the police that a shed at a market garden at 340 Cranford Street had been broken into on July 29, said Sergeant J. D. Shields. A padlock on the.door of the shed had been broken and 47 bags , of onions taken.

On August 7 two bags were recovered from a shop and Basan was subsequently interviewed. He admitted receiving the onions and said he had sold them to shops and hotels in various parts of the countryside. TOOK VEHICLE

Charged with unlawfully taking a vehicle on August 26, John Sidney Johnson, aged 21, unemployed, was convicted and remanded on bail to today for sentence. He pleaded guilty.

Johnson hired a van in Auckland last Friday and undertook to return it before 8 a.m. on Monday, said Detective Sergeant R. G. McMeeking. Instead he drove it to Wellington and left it outside the railway station and caught the ferry to Lyttelton.

Johnson left the keys of the van in the ignition switch and the petrol tank was full. He apparently did not think he was committing an offence and that the S4O deposit he had paid would cover costs. The firm claimed $l3B to cover the excess mileage, petrol and the fare of a member of the staff who had to be sent from Auckland to get the van. Johnson said he realised he had acted unreasonably and that when he started work as a shearer he would be able to pay the full amount asked for. BURGLARY On a charge of breaking and entering a house in Brisbane Street on July 11, Patrick Ngatai Ruawai, aged 19, an unemployed workman, was convicted and remanded on bail to September 9 for sentence. He pleaded guilty. Sergeant Shields said the defendant admitted taking clothing and other property valued at $197 because he had no clothes. Articles valued at $162 had not been recovered, and

restitution of this amount was sought. SHOPLIFTING

Alexander Gasparics, aged 33, an unemployed barman, was convicted and remanded on bail to September 9 for sentence on a charge of stealing cigars valued at $1.15 and a clock valued at $3.50 from the High Street branch of Woolworths (N.Z.), Ltd, on August 27. He pleaded guilty. Sergeant Shields said two members of the store staff apprehended the defendant. The defendant admitted taking the goods without paying, and could give no explanation for his action. He had $25.87 in his possession when arrested. NAME SUPPRESSED A woman, whose name was suppressed, was convicted and remanded on bail to September 9 for sentence on a charge of theft of $116.67 at Christchurch on June 21. She pleaded guilty. ASSAULT On a charge of assaulting Brian George Palleson at Hastings on June 11, Jack Black Te Aho, aged 30, a shearer, was convicted and remanded on bail to September 9 for sentence. He pleaded guilty. Sergeant Shields said the defendant assaulted a Hastings taxi driver who remonstrated with him over his attitude to paying the fare. The driver refused to accept his watch as security for payment. FINED $4O, DISQUALIFIED Appearing for sentence on a charge of driving while disqualified, Wilson Donald Hogg, aged 27, a textile pest controller, was fined $2O and his disqualification was extended for one year. On a charge of wilful damage at the Tabou Nite Club he was fined $2O and ordered to pay restitution of $5. Witnesses’ expenses were $lO. OBSCENE LANGUAGE Ronald Robert George Lee, aged 26, a fisherman, was convicted and fined $2O on a charge of using obscene language in a car park on August 10. He pleaded guilty. WARRANT ISSUED A Bench warrant was issued for the arrest of Norman William Cole, aged 47, unemployed, when he failed to appear on charges of receiving 47 bags of onions worth $127 on July 29, and burglary of a shed at 340 Cranford Street on July 28. FOUND IN BAR On a charge of being found in the Gresham Hotel bar while a minor on June 6, Nuni Paul, aged 17, a workman, was convicted and fined $7. He pleaded guilty. TRAFFIC OFFENCES In police traffic prosecutions convictions were entered and fines were imposed as follows: Failed to give way to the right: Gregory Edward Cunneen, $2O, disqualified from driving for two months from September 11: George Ferris. $l5 (no warrant of fitness, costs only); Michael Charles Narbey, $2O. Careless use of motor vehicle: David Owen Williams, $5, disqualified from driving for three months.

Bernard Francis Basan, aged 41. unemployed, was. committed to the Supreme Court for trial on a charge of escaping from the custody of Constable M. B. Haussmann on August 15. Basan pleaded not guilty after depositions had been taken, and was remanded on bail.

Constable Haussmann said he stopped a truck in Camden Street at 7.30 p.m. Basan was driving and he was told he was arrested for driving while Intoxicated. He was put in the police car. Witness said he was approached by a person known to him as Maxwell Carlton Carney, who asked for the keys of the truck as it was his truck.

Basan then lumped out of the police car, and ran across the road into a private property. Police dogs were obtained, but no trace of Basan was found.

Constable Haussmann said he did not chase Basan far as the motor of the police car was running, and he did not think it prudent *to leave the car with Carnejr in the vicinity.

Constable A. T. Turnbull said he arrested Basan on August 16. Basan said he escaped from Constable Haussmann because he did not think he was unfit to drive. He said he realised that he had been arrested. (Before Mr W. F. Brown, S.M.) PROBATION AND FINE

“You have got a bad record for a person of your age and the probation officer suggests that it would help you to have a period of supervision,” the Magistrate said when Manson Robert Dean, aged 19, a salesman, appeared for sentence on a charge of driving while disqualified. Dean was admitted to probation for a year, was ordered to live and work where directed, was fined $3O, ordered to pay Court costs of $5 and his driver’s licence was cancelled for a year. On a charge of exceeding 30 miles an hour he was fined $25 and he was ordered to pay costs of $5 on a charge of having no warrant of fitness. DISCHARGED A young man, whose name was suppressed, was discharged without conviction under section 42 of the Criminal Justice Act on a charge of theft of a cheque for $100.30. Mr G. R. Lascelles, for the accused, said that $3O had been paid towards the cost of prosecution. SUSPENDED SENTENCE A man, whose name was suppressed, was convicted and ordered to come up for sentence if called upon within one year when he appeared for sentence on a charge of assaulting his son on August 5. The accused had pleaded not guilty to the charge but had been convicted.

Mr W. H. McMenamin, for the accused, said that the offence occurred because of domestic strife.

“It was unfortunate that you decided to Involve your small son in the dispute between

yourself and your wife,” the Magistrate said. “You must realise that you must not take your feelings about your wife out on a young child.’’ BENCH WARRANT A bench warrant was issued for the arrest of Garry Raymond Blewett, aged 17, unemployed, when he failed to appear on a charge of wilfully obstructing Constable Lynden John Kilkelly in the execution of his duty on August 11. DROVE WHILE DISQUALIFIED Kevin William Jennings, unemployed, was fined $4O and his driver’s licence was cancelled for a year on a charge of driving while disqualified. Traffic Officer G. F. Herridge, of the Transport Department, said he stopped a car driven by Jennings in Blenheim Road. He was suspicious and checked with the Waimairi County Council and found that Jennings was disqualified. Jennings told the Court that he thought his peritd of disqualification had expired. "This is a very serious offence and I am not impressed by your excuse,” the Magistrate said. "If you drive again while disqualified you will go to prison.” OTHER TRAFFIC CHARGES On charges brought by the Transport Department fines were imposed as follows with costs of $5 on each charge.
