MAGISTRATE’S COURT Charge Of Obstructing Police Denied

Prosecution evidence sod some of the evidence to be called for the defence on a charge against Robert Tsillct Fryer, aged 18, a shipwright’s labourer (Mr G. T. Mahon), of wilfully obstructing Constable Paul James Cunneen in the execution of his duty at Lyttelton on July 27 was heard by Mr W. F. Brown, S.M., in the Magistrate’s Court yesterday. The hearing will continue today. The defendant pleaded not I guilty to the charge. ; Constable Cunneen said in evidence that he called out to the occupants' of the yacht Beasley County, tied up at Cashin Quay, about 10.45 p.m. on July 27. He believed Antonius Oud to be on board, and he intended to execute two Bench warrants for his arrest Both Oud and the defendant came on deck. Oud refused to come on to the wharf because the witness did not have the warrants with him at the time. The defendant assisted Oud while be bailed out the dinghy. The defendant was warned not to assist Oud to escape, and that to do so would amount to obstruction. The defendant untied the dinghy and Oud rowed it under the wharf. He had not been found since then. Constable Cunneen said he arrested the defendant and charged him with wilful obstruction. Mr Mahon submitted that on the police case there was no evidence of Intent on the part of the defendant to assist Oud to escape and thereby obstruct the police. The defendant said in evidence that both he and Gladys Hay. who was also on the yacht, told Oud he should go on to the wharf and get the matter cleared up. Oud agreed to do this. The only means he could use to reach the ladder on the wharf was the dinghy. “When he pushed off I thought he was going up the ladder. Instead, he went straight under the wharf.” THEFT OF WALLET Rex Malcolm Weir, aged 22, an unemployed workman (Mr R J. Allan) was convicted and remanded on bail to August 27 for sentence on a charge of theft of a wallet and contents valued at $l3 on August 3. He pleaded not guilty. Brent Nelson Hodder, the complainant, said in evidence he dropped his wallet in a New Brighton amusement area on August 3 while driving a gokart. Before he eould pick it up the manager of the track picked it up and the defendant claimed it from him. He said he approached the defendant for his wallet but be refused to return it. The defendant said the wallet handed to him by the track manager was his own. The defendant said in evidence that he bad dropped his wallet on the go-kart track, and that this was the one handed back by the manager. He was concerned only with his own wallet, and knew nothing about any other. The Magistrate said an overwhelming case had been made out against the defendant. BORSTAL AND DETENTION Norman Anthony Joseph Wade, aged 19, an unemployed workman, was sentenced to Borstal training, and Glen Walter Vineent, aged 19, an unemployed workman, was sentenced to detention centre training when they appeared for sentence on live joint charges of unlawfully taking motor-vehicles in Plcton, Napier, Auckland. Islington and Oamaru in July and August. The Magistrate said the circumstances of the offences were very serious. "It is bard to imagine worse cases of unlawfully taking motor-vehicles," be said.

THEFT AS SEVANT Frank Reginald Edwards, aged 56, a cleaner (Mr R. H. Stringer) was lined $5O when he appeared for sentence on a charge of theft of clothing and records valued at $54.19 from the D.1.C., Ltd, between June 26 and August 9. He had previously been convicted. Mr Stringer said it was hard to understand how the defendant came to appear before the Court on such a charge. His work record spoke for Itself, and In every respect he was an exemplary citizen. It was a completely Isolated incident. The Magistrate said the case was not a gross one of its kind. The defendant, however, should have known better. NAME SUPPRESSED A youth, wboee name was suppressed (Mr R. W. Russell), was remanded on ball to August 27 on a charge of theft of car parts valued at 5160 on July 15. He pleaded guilty. The Magistrate reserved his decision on conviction and sentence until the date of remand. Sergeant V. F. Townshend said the defendant assisted another person to carry the parts to a car. He gained nothing from the theft for himself. The other person involved, whose name also was suppressed (Mr L. M. O’Reilly) was convicted on the charge of theft and was remanded on ball to August 27 tor sentence. He pleaded guilty. FOUND IN YARD Graham Douglas Arnett, aged 22. a cabinet maker, was ffned a total of $4O on charges of being found unlawfully in an enclosed yard in Hoanl Street and wilfully damaging a mattress. the property of the police department, when he appeared tor sentence. He had previously been convicted. The defendant was ordered to pay restitution of $7.62, the value of the mattress destroyed. APPLE THEFT Phillip Bernard Redmond, aged 21, a driver, was fined 540 when he appeared for sentence on a charge of theft of a case of apples valued at $1.50 on June 30. He had previously pleaded guilty and been convicted. CARELESS DRIVING On a charge of careless driving in Carlyle Street on July 4, Brian James Graham, aged 17. an apprentice carpet layer (Mr G. C. P. Beadel), was convicted and lined $5. and disqualified for three months. He pleaded guilty. LIQUOR OFFENCES In prosecutions under the Sale of Liquor Act, convictions were entered and fines were Imposed as follows: Minor found in hotel bar: John William Langdon, $3 (false particulars, SS). Supplied minor with liquor: Irwin Knight, $4. (Before Mr P. L. Mollneaux, S.M.) LICENCE CANCELLED Ross Thomas Le Compte, an assistant manager, was fined $4O and his driver’s licence was cancelled for a year on a charge of driving at a speed which might have been dangerous at Halswell on May 22. He pleaded not guilty and was represented by Mr B. A. Barrer. FINED $2O Peter Butzbach, a technician, was fined $2O and was ordered to pay witnesses’ expenses of *8 and bis driver's licence was cancelled for two months on a charge of failing to stop at a stop sign at the corner of Hills Road and Warrington Street on June 7. He pleaded guilty. Butzbach was originally charged with driving In a dangerous manner. He pleaded not guilty to this charge which was reduced to one of failing to stop at a stop sign. Mr C. B. Atkinson appeared for the defendant (Before Mr K. H. J. Headifen S.M.) TWO LICENCES Brian Charles Goldsmith, aged 22, a university student, had obtained a second driver’s licence at Auckland in the name of Bruce Charlesworth Golds just for "kicks," the Magistrate was told. Goldsmith was fined 515 for obtaining the second licence $l5 for obstructing a traffic oncer in the execution of bis duty, and 56 for being double parked. The Magistrate was told that Goldsmith had given hie correct name when interviewed about the parking offence, but that he had later visited the frame department and claimed that he was really Bruce Charlesworth Gold*. Be bad produced a licence in that name. His own licence, obtained at Hastings in 1962, was later found to have been endorsed for an offence in 1967. The Magistrate said Goldsmith had written to the Court asking that hie name be suppressed. "Under no circumstances would I consider it, even if this were not a traffic court,” the Magistrate said. IGNORED PATROL

Jeanette Ward Hodgen, a Karltane nurse, told the Magistrate that she failed to stop tor a Spreydon School crossing patrol in Halswell Road on June 11 because she was uncertain whether the sign was extended or not.

The Magistrate told her that the Courts took a serious view of such offences because children were specifically trained to cross only when the signs were extended. They were told that It was safe to cross, and any motorist who disregarded the signs placed them in an Immediate state of peril. Usually such a driver's licence would be cancelled, but In view of Miss Hodgen’s occupation and of the tact that she lived at Ladbrooks, she would be fined 520 and ordered to attend three lectures at the City Council's traffic improvement school.
