MAGISTRATE’S COURT Young Man Imprisoned For Six Months On Assault Charge

Six months imprisonment was imposed on Donald Allan Stewart, aged 21, a farm labourer. when he appeared before Mr E. S. J. Crutchley, S.M., in the Magistrate’s Court yesterday for sentence on a charge of assaulting Constable H. T. Surgenor in the execution of his duty and assaulting George Miller. Both offences were committed on June 28. Stewart was not represented by counsel. “You have had three previous convictions for assault and have got a shocking record for a person of your age,'* the Magistrate said. “You have shown no response to probation and you are determined to go your own way. You are not prepared to accept help and resort to viciousness when you consider yourself provoked. Fines and probation have proved useless." “BRUTAL ASSAULT” Hemi Richard Morgan, aged 47, a machine-operator, was admitted to probation for 18 months and was ordered to abstain from liquor for the period of his probation when he appeared for sentence on a charge of assaulting his wife, May Morgan, on June 1. Mr L. M. O’Reilly, for the accused, said it was a fairly serious offence. Morgan was receiving $35 a week compensation because of a back injury. It did not say much for the family environment when the parents were in different hotels. Some of the blows were struck after Morgan’s wife interfered with the steering wheel and gear-lever of the van. Morgan saw his wife embracing a man and removed her from the house where she was drinking but used more force than was necessary. He realised that he could be sent to prison for the offence. “It was a brutal assault and you treated your wife something like an animal,” the Magistrate said: “Your actions arose because of temper and jealousy. There is no point in sending you to prison as you have seven children to look after.” PROBATION AND FINED $lOO Peter Ronald Smith, aged 17, a seaman, was admitted to probation for two years, was fined a total of $lOO, and was ordered to pay Court costs of $lO and ordered to abstain from liquor during the term of his probation when he appeared for sentence on charges of assaulting Constable L M. Gardiner in the execution of his duty and escaping from lawful custody on June 28. Mr G. R. Lascelles, for the accused, said this was Smith’s first appearance in the Magistrate’s Court On the spur of the moment he misguidedly went to the assistance of a friend. Liquor and irresponsible friends had played a part in the offences. He had a very good discharge from all the ships he had served on. “Police officers are not to be treated by you or anyone else in this manner,” said the Magistrate. “One bright spot is that you have a very good work record.” PROBATION FOR BURGLARY Roderick Paul Brown, aged 24, a factory worker, was admitted to probation for two years and was ordered to take psychiatric treatment when he appeared for sentence on a charge of burglary of Selwyn Casewoods (McVicar). Ltd, Johns Road, on June IS.

•‘You have previous convictions relating to burglary,” the Magistrate said. “The probation officer's report says that you are not disposed towards crime and that the offence was caused by emotional difficulties. It is with considerable hesitation that I release you on probation.”

ORDER FOR DEPORTATION Lameka Taotua, aged 24, a Western Samoan freezing worker, was convicted on a charge of remaining in New Zealand after his permit had expired and was remanded in custody pending deportation under section 20 of the Immigration Act. Taotua pleaded not guilty. Mr C. McVeigh prosecuted. The Rev. K. Faletoese, who acted as interpreter, apologised to the Court for Taotua for his misbehaviour, and said that his offences had been caused by liquor. DROVE UNDER INFLUENCE A fine of ISO and disqualification from driving for three {ears, witnesses* expenses IS.M, was imposed on Maurice McKay, aged 51, a labourer <Mr S. G. Erber). when he was convicted on a charge of driving in Clarence Road while under the influence of drink or drugs, on June 3. He pleaded not guilty. The Magistrate said there was some conflict of evidence, but there was no reason to doubt

the evidence of the traffic officer. Experienced police officers and a doctor all considered McKay under the Influence of liquor, and the defendant s own account of how much he had drunk did not correspond with his condition as described by the doctor. ASSAULTED WIFE When his wife threw a pillow at him the defendant hit her three or four times around her face with his open hand, the Court was told when Glen Morris Barron, aged 18, a locomotive trainee, pleaded guilty to a charge of assaulting his wife, Sandra Mary Barron, on July S. He was convicted and flned no. Sergeant A. D. Stevenson said the defendant and his wife bad an argument at 12.30 a.m., and the assault occurred. Mrs Barron had since told the police she did not wish to give evidence against her husband if required to. STOLE POTATOES Pleading guilty to theft of two sacks of potatoes worth 34 from his employer, the Railways Department, Leslie Samuel Beard, aged 40, a traffic assistant, was convicted and remanded on bail to July 14 for sentence. Police saw a railway worker take seven bags of potatoes from a waggon and place them in his car, said Sergeant Stevenson. A check was made of the waggon, and a total of 14 bags was found to be missing. Inquiries were made and Beard admitted stealing two sacks. BURGLARY ADMITTED Frederick Tressilllan Hicks, aged 10, an apprentice wood machinist, was convicted and remanded in custody to July 10 for sentence on six charges of burglary, to which he pleaded guilty. . k . The charges concerned breaking and entering the premises of Mooar and Stanley, 127 Wordsworth Street, on May 23 and May 29; Wholesale Discount Service, 10 Papanul Road, on June 20; Douglas Footwear and Company. Ltd. 09 Casson Street, on June 24 and May 30; and R. J. Hampton, Ltd, corner of Kilmore Street and Fingeraid Avenue, on July 2. Sergeant Stevenson said Hicks stole property worth a total of 3384. of which 091 worth had been recovered. THEFT AS A SERVANT On six chargee of theft as a servant of tinned fruit and coffee worth 0144 betwen June 4 and June 10. a youth, whole name was suppressed (Mr R. K. Godfrey), was convicted and remanded on bail to July 16 for sentence. He pleaded guilty to all charges. The defendant had been approached by a fellow employee and asked to give him some coffee for a friend who was setting up a grocery business, said Sergeant Stevenson. This was done several times. The defendant said he got on well with the other man and thought he was doing him a good turn. FINED 826 Boyd Neville Busen, aged 26. a furniture manufacturer, was lined SIS on a charge of failing to report damage to the cycle of David Murray Jackson, and 35 on a charge of careless driving in Straven Road on April 3. He was ordered to pay Court costs of 110 and witnesses’ expenses of 36. Busen. who pleaded not guilty, was represented by Mr A. K. Archer. The Magistrate said he accepted that the defendant was in a position of some difficulty when the offences were committed.
