MAGISTRATE’S COURT Youth Fined $4O And Licence Cancelled For Two Years

Trevor William Tait, aged 17, unemployed, pleaded guilty in the Magistrate’s Court yesterday to a charge that on November 23, in Colombo Street, he drove in a manner which might have been dangerous. Tait was convicted by Mr K. H. J. Headifen, S.M., fined $4O and disqualified for two years. Sergeant V. F. Townshend said Tait was driving in Colombo Street at a speed of between 30 and 35 m.p.h. On approaching a set of traffic lights which were red he passed another vehicle; waiting to turn right, on the toft, then swerved back missing the front of that vehicle by inches. He then drove on Colombo Street on the incorrect side of the road forcing an oncoming vehicle into the kerb. His speed had then increased to about 50 m.p.h. When located in the Cashmere area about 20 minutes later he had admitted driving at speeds of 35 to 40 m.p.h., but claimed the traffic light had been green and denied driving on the incorrect side of the road. He had said if his licence was cancelled he was going to drive his car in any case, and “ho cop was going stop him.” FIVE CHARGES

Ralph James Murray, aged 20, unemployed, was re-

manded to February 8 for a medical examination to see if he was fit to be sent to a detention centre when he appeared for sentence on three charges of driving while disqualified, and one of driving with worn tyres and one of failing to comply with the order of a policeman not to drive a vehicle on the road. Mr L. M. O’Reilly appeared for the accused.

Mr O’Reilly said he could not put forward any explanation of merit except that Murray was a rather immature, weak youth. He had not appreciated the seriousness of the offences. He was a pretty frightened young man. The short time he had been in custody had a good effect on him.

“The Court has the choice of either imposing a substantial term of imprisonment or sending you to a detention centre,” the Magistrate said. “I am by no means impressed by your attitude that you are a tough guy who knows how to - handle persons in authority.” FOUR CHARGED Tory John Waaka, aged 2S, ah unemployed shearer, pleaded guilty to a charge of breaking and entering Taylors Dry Cleaning and Laundry Services, Ltd, 57 Kilmore Street, on January I. He elected trial by jury on a charge of breaking and entering the workshop of L. C. Hunton’s, Ltd, 55 Kilmore Street, on the same date.

Douglas Raymond Henry, aged 24, an unemployed truck driver, pleaded guilty to breaking and entering Hunton’s and elected trial by jury on a charge of breaking and entering Taylors. George Toko Whatuira, aged 20, an apprentice panel beater, pleaded guilty to breaking and entering Taylors and after electing summary jurisdiction pleaded not guilty to breaking into Huntons.

Michael Eddie Pomana. aged 24, an unemployed truck driver, pleaded guilty to breaking and entering both Taylors and Huntons.

On the charge to which each had pleaded guilty each was convicted and remanded in custody to February 13 for a probation officer’s report and sentence.

Waaka and Henry, on the charge on which each had eleced trial by jury, were remanded to the same date on those charges. Whatuira on the charge on which he elected summary jurisdiction and pleaded not guilty, was remanded to February 14 for a hearing of that charge. Mr K. N. Hampton appeared for the four men. SHOPLIFTING James Norman Havord. aged 57, a retired Post Office worker, was fined $3O on a charge of stealing cigarettes, tobacco, chocolate and peanuts, valued at 52.44, from the shop of Hay’s, Ltd, at Northlands Supermarket. He pleaded guilty. Sergeant Downes said that at 10.50 a.m. that day Havord was seen to take a packet of cigarettes and leave the shop without paying for them. When taken to the manager’s office, Havord offered to pay for the cigarettes. The police were called and when Havord was searched he was found to have a number of other items which he had stolen.

DRUNK James Rankin, aged 41, an unemployed fitter’s mate, pleaded guilty to a charge of being drunk in High Street and admitted four convictions for drunkenness in the last six months. He was convicted and fined $2ll, in default 12 days imprisonment. OTHER CHARGES In other prosecutions brought by the police, convictions were entered and penalties imposed
