DIVORCE COSTS
Three Judges To Inquire Whether a successful petitioner in an undefended divorce case should be allowed the expenses incurred by a private inquiry agent as part of her costs will be decided in the Supreme Court on Monday next. As a favourable decision would create legal precedent, the matter will be considered by a full court of the three South Island Supreme Court judges—Mr Justice Henry (Dunedin), Mr Justice Macarthur, and Mr Justice Wilson.
The petitioner has applied for the inquiry agent’s expenses to be included as part of her costs on the ground that such expenses were necessary payments in her cause, arid on the further ground that their inclusion is “just and proper.”
