MAGISTRATE’S COURT Charge Of Reckless Driving Admitted By Youth

A 19-year-old advertising agent, William Douglas Oldham, pleaded guilty to a charge of reckless driving in Caledonian road and Edgeware road and Sherborne street on August 27 when he appeared in the Magistrate’s Court before Mr H. J. Evans S.M. yesterday. The hearing was adjourned till November 28.

Traffic Sergeant H. J. McMorran said Oldham was reversing south along Caledonian road when his driving forced another vehicle travelling north to brake severely and pull to the incorrect side to overtake. The overtaking vehicle had sounded its horn. Oldham a short time later overtook that vehicle, cut sharply in front of it and braked severely slowing to 5 m.p.h. As the vehicle again moved out to overtake Oldham accelerated or braked forcing the other vehicle to remain on the incorrect side of the road. At the intersection with Edgeware road Oldham pulled sharply to the right forcing the other vehicle to stop. The other vehicle then proceeded along Edgeware road but Oldham again overtook, braked and when the other vehicle again attempted to overtake Oldham repeated his manoeuvring to keep it on the incorrect side of the road. The other vehicle had been forced to cross the intersection with Colombo street on the incorrect side of Edgeware road. Both vehicles stopped for the compulsory'stop at Sherborne street.

Although the other vehicle had intended turning left it turned right. Oldham had again overtaken it, pulled in front, and when it attempted to regain the correct side had prevented it from doing so. Oldham had then again cut over on to the other vehicle forcing it to stop. After stopping for some minutes Oldham drove off. The driver of the other vehicle was accompanied by his wife and two children, Sergeant McMorran said. Mr Erber asked that the question of penalty be held over till November 28 when Oldham was to appear for sentence on a charge of driving while intoxicated and dangerous driving. DISQUALIFIED DRIVER John Richard Sheldon, aged 29, a rubber worker, (Mr L. M. O’Reilly) pleaded guilty to a charge of driving in Beresford street on November 5 while disqualified. He was convicted and fined £25 and disqualified for a further 12 months. Mr O’Reilly said that Sheldon since being disqualified in February had abided by the terms of that disqualification. However on November 5 he had gone shopping at New Brighton and had later met two friends at a hotel. The two friends, who were both unfit to drive, had offered to drive him home, even though he had indicated he was going by taxi. The friends had insisted on driving him and, being concerned that regardless of what he did his friends would still drive, he had offered to drive them to their home. FAILED TO DISPLAY L PLATES Graeme Keith Nicholl, aged 20 an apprentice motor mechanic (Mr H. P. C. Tipping) was convicted, fined £lO and disqualified for three months after the Magistrate had given his reserved decision in which he had found Nicholl guilty of driving on September 14 while failing to display L plates as required. APPEARED FOR SENTENCE “With some reluctance I have decided not to send you to prison,” said the Magistrate when Daniel Alfred Kapo, aged 21, a carpenter (Mr J. R. Williams) appeared for sentence on charges of carelessly using a motor vehicle, failing to stop after an accident, having no driver’s licence and failing to ascertain whether anyone was injured in Stanmore road on October 22. Kapo was convicted on all charges. On the charge of failing to stop after an accident, Kapo was fined £3O and on the charge of failing to ascertain whether anyone was injured Kapo was ordered to pay costs only. Kapo was disqualified from holding or obtaining a driver’s licence for 12 months on these charges. He was fined £2O fo having no driver’s licence and £lO for carelessly using the motor vehicle. For each of these charges he was disqualified from holding a driver’s licence for 12 months. All the periods of disqualification will run concurrently. FINED £5O

Henry Hona, aged 35, a lineman (Mr M. F. Hobbs) was convicted, fined £5O and disqualified from holding or obtaining a driver’s licence for 15 months when he appeared for sentence on a charge of driving a motor vehicle whilst disqualified in Stanmore road on September 22. Hona was also placed on probation for 12 months and ordered to pay the fine as and when directed by the probation officer. On June 27, about 1.30 p.m. or 2 p.m., his coal truck was parked by the kerb in Pages road, said Thomas Henry PhilMpson, a driver. When he got back into the truck before driving off, it was struck from behind by a van driven by Skellerup. FAILED TO KEEP LEFT Thomas Netlings Thomson appeared on a charge of carelessly using a motor-vehicle on Bliigbs road. He pleaded not guilty.
