Magistrate's Court Driver Fined And Disqualified

I "This defendant practically i got down on his knees and asked for his licence to be taken away; he could not have done much more to ensure this," said Mr K. H. J. Headifen, S.M., in the Magistrate’s Court yesterday, when convicting a driver on three charges. He fined William Owen Alexander, aged 33. a driver (Mr P D. A. Hinchcliffe), £l5 and disqualified him for nine months on a charge of failing to stop after an accident in Montreal street on August 9. He also fined him £8 on a charge of careless use of a motor vehicle, and £5 on a charge of failing to ascertain injuries, on the same date. Alexander pleaded guilty to all charges. The period of disqualification begins on September 20.

Sergeant G. M. Mulcare said that about 9.30 p.m., when the defendant was driving along Montreal street the car he was driving swung on to the incorrent side of the road and struck a parked car. The defendant did not stop. The defendant told the police that he had had a fit of sneezing. He said he thought he had just hit the kerbing, although when he returned home he realised from the damage that there had been "more to it.” He admitted having 10 to 15 fiveounce glasses of beer, Sergeant Mulcare said.

“1 have doubts about whether this person is safe on the roads,” the Magistrate said. “I see that the defendant was convicted of a charge of careless use causing bodily injury on March 5 last year. On that occasion he was fined £l5 and put off the roads for three months. “The fact that no-one was hurt is purely fortuitous,” he said. "The defendant admits he had been drinking, and when he hit a parked car he believed he only hit the kerb. I don’t think there is much that can be said for the defendant.” BEGGED FOR ALMS

Charles George Reede, aged 66, a pensioner, was convicted and sentenced to three months’ imprisonment on a charge of being idle and disorderly in that he begged for alms in Harman street yesterday. He pleaded guilty. Sergeant Mulcare said at 11.30 a.m. in Harman street yesterday Reede had been observed to stop a youth on a bicycle. He had stopped other youths on bicycles and later a man was seen to give Reede a silver coin. Reede had a two-shill-ing piece and six pennies in his possession at the time of his arrest, Sergeant Mulcare said. VANDALISM

“I will not tolerate such vandalism,” said the Magistrate when Anthony Cyril Ellis, aged 18, unemployed, was convicted and fined £2O on a charge of riding a powercycle through the flower beds in St. Albans Park on July 10. He pleaded guilty. On a charge of having no driver’s licence, Ellis was convicted and fined £5.

“The local ratepayer has turned the city of Christchurch into one of the most beautiful in New Zealand," said the Magistrate. “These parks and gardens give a lot of pleasure to the citizens of Christchurch.

“Your driving deliberately through the flower beds is nothing but loutish behaviour,” said the Magistrate. "Very well, you can help the ratepayers in keeping the gardens in good order. “During the reading of the evidence I had considered a period at a detention centre for you,” the Magistrate said.

FINED £25 A fine of £25 was imposed on Ivan Ngawhua Watene, aged 24, a truck driver, when he was convicted on a charge of having unlawful sexual intercourse with a girl aged 15 years five months, on August 19. He pleaded guilty. Sergeant Mulcare said Watene met the girl at a party in Rutherford street and she went home with him. The girl did not tell him she was not 16.

FINED £5 Clarence John Seabourne, aged 41, a driver (Mr K. M. Hampton), was convicted and fined £5 on a charge of pro ceeding over a compulsory stop when the way was not clear at the intersection of Ferrv road and Barber street on May 7. The defendant, who pleaded not guilty, was also ordered to pay witnesses’ expenses of £l7. CHARGES DISMISSED William Alfred Edward Haney, aged 47, a linesman (Mr J « Dalmer), pleaded not guilty to a charge of failing to yield the right of way at lhe HitersecNon of Bexley and Dyers roads about 3.30 p.m. on July 24. The charge was di amused.

Charles Sclater Brittenden. aged 50. a driver (Mr R. L. Kerr), pleaded not guilty to a charge that he failed to yie.d the right of way at the Intersection of Peterborough and Manchester atreets on March 11. The charge was diamtssed.

INSUFFICIENT MEANS Leslie Campbell, aged 44, and Leonard Archibald King, aged 32, were further remanded to September 15 for sentence, on a charge of being Idle and dsorderly. In that they had insufli cient lawful means of support on September 8. They had previously been convicted and remanded to yesterday. Sergeant V. F. Townshend said that the house at 41 Wrights road, where the two men had been arrested, was owned by the widow from whom ths two had been getting food and money. It was in a neglected slate. Many people of suspect means had lived there and some still were, he said. CHARGE DISMISSED A charge against a man, whose name was suppressed. of obscene exposure on July 21 (Mr A. D. Glue) was convicted and lined £lO on a charge of falling to render all practicable assistance to an injured person on Cambridge terrace on June 27. FAILED TO GIVE WAY Arthur Walsh Schofield, aged 42, a truck salesman, was con victed and fined £8 on a charge of failing to give way to the right on July 26 at the corner of Gloucester street and Barbadoes street. He pleaded not guitty. CHARGE DISMISSED A charge of permitting a person to ride in a dangerous manner on a motor vehicle on July 13 in Todd avenue against James Thomae Smith, aged 29. a milk vendor (Mr B. S McLaughlin) was dismissed. He pleaded not guilty.
