NEW TRIAL ORDERED
Man Convicted Of Indecency (N.Z. Press Association) WELLINGTON, April 5. A new trial for a Christchurch man convicted of indecent assault was ordered today by the Court of Appeal. The Court allowed an appeal by Frederick Arthur Rumble, who was convicted in the Supreme Court at Christchurch on February 10 before Mr Justice Wilson and a jury.
Yesterday, Rumble’s counsel, Mr B. J. Drake, submitted that the jury’s verdict was unreasonable and could not be supported by the evidence, and that there was a miscarriage of justice in that the Judge misdirected the jury.
The Court which heard the appeal comprised Mr Justice North, Mr Justice Turner, and Mr Justice McCarthy.
