Daniel Frank Freitas, retired, of Greymouth, was fined £lO by Mr E. A. Lee, S.M., in the Magistrate’s Court yesterday on a charge of selling crayfish tails less than 6in in length. He pleaded not guilty, and was represented by Mr P. G. S. Penlington. A charge against Philip Prendergast, a fisherman, of Greymouth, of having undersized crayfish in his possession was dismissed. He also pleaded not guilty. It was perfectly clear from the evidence that Freitas was the consignee and the owner of the crayfish and that he sold them, the Magistrate said. His liability under the regulations was absolute. The law completely precluded the sale of under-sized crayfish, and even if Freitas was unaware of under-sized crayfish in the consignment the law held him responsible. Prendergast had been fishing for many years and, except for this one shipload of crayfish tails, had not been convicted of any breaches of the regulation, said the Magistrate. This suggested that he would not wilfully bring in under-sized crayfish.
