Magistrate’s Court Six Months’ Gaol For Conversion And Theft

Six months’ imprisonment was imposed on Trevor Thomas King, aged 34, a carpenter, when he appeared for sentence before Mt E. A. Lee, S.M. in the Magistrate’s Court yesterday on charges of unlawful conversion and theft of articles valued at £34 ss. Mr M. F. Hobbs, who appeared for the accused, said that King suffered from a compulsion during the summer months. He was anxious to take treatment.

“You have had 14 years to deal with your problem," the Magistrate said to King. “You have a large number of convictions. including many for theft of articles other than women’s clothing. Thefts from cars are far too common. The car involved in this offence was locked, and you broke it open. FINED £l5 Leonard Donald Spicer, aged 49 a fish filleter <Mr J. A. Bretherton). was fined £l5 for assaulting Constable C. A. B. Drain, convicted and discharged •n a charge of resisting Constable Drain tn the execution of his duty, and ordered to pay roMs on a charge of unlawfully entering a garage in Walrakei mad He was ordered to make restitution of £2l 10s 6d for damage caused to clothing.

Mr Bretherton said the offences occurred after Spicer had attended a wedding. He was not a drinker. He saw a rar in the garage which was similar to his own. and was quite openly examining the suspension with a torch when he was seen by a neighbour. When the constable arrived there was a struggle and Spicer suffered injuries which required 11 stitches. Five civilians had to assist the constable to restrain him. Normally Spicer was quiet and inoffensive. “I accept that you had an Innocent motive in entering the garage,'* the Magistrate said to Spicer “Your judgment had been impaired by the consumption of liquor which you were not used to. However, the Court takes a serious view of an offence in which a person, whether drunk or sober, assaults a policemen.” BORSTAL “You have a dreadful record nf anti-social conduct, including two assaults on police officers and three or four obscene language convictions,” said the Magistrate when he sentenced Allan James Thompson, aged 18. a factory labourer, to Borstal training. Thompson was appearing for sentence on charges of obscene language and resisting a constable on December 4. The Magistrate said that even though Thompson had been to a detention centre and had served a term of imprisonment, he needed a longer term of supervision. THREE CHARGES Robert Thomas Webster, aged 20 an unemployed ship’s steward <Mr G. R. Lascelles), was convicted and remanded in custody to December 15 for sentence when he pleaded guilty to a charge of being a rogue and a vagabond in that, being a suspected person. he frequented Derby street and Bealey avenue with felonious intent on November 18. He was also convicted and similarly remanded on charges of theft of a car radio valued at £45 and a raincoat valued at

£4 on the same date, to which he also pleaded guilty. Sergeant P. J. AKy said that at 5.20 p.m. on November 18 two detectives travelling home by car saw the accused loitering on the side of the road. Knowing bis character and reputation. they watched him enter several driveways. After walking up three drive, in Bealey avenue, he opened the door of a car. The accused ran away when the detectives approached, but was caught in Churchill street. REMANDED IN CUSTODY Albert John Friars, aged 17. a musterer <Mr M. J. Glue), and Rang! Phillip Henare, aged 21, a labourer, were remanded in custody to today for a medical examination to ascertain their fitness to be sent to a detention centre. They were appearing for sentence on joint charges of breaking and entering on November 22 and theft on or about November 22. Henare was also appearing for sentence on a charge of breach of probation on October It.

FALSE PRETENCES Robert James Dunick, aged 32. a machine operator, pleaded guilty to eight charges of false pretences involving the issue of valueless cheques. He was remanded to appear at Dunedin on December 13 on six of the charges and to appear at Christchurch on December 22 on two of the charges. OBSCENE EXPOSURE Appearing for sentence on a charge of obscene exposure on November 24. a man, whose name was suppressed fMr R. H. Godfrey), was fined £2O. INTERFERED WITH CAR Robert Frederick Shackel, aged 17. a salesman, and Allan James Coates, aged 18, an apprentice frame-maker, were remanded on bail to December 18 for sentence on a joint charge of Interfering with a car on December 8. They pleaded guilty. Sergeant V. F. Townshend said that at 9.15 p.m. on Wednesday the accused entered a car sales yard in Colombo street. They crouched down behind a car, and Coates was seen removing a tail-light from it. Mr S. G. Erber, who appeared for both accused, applied for suppression of their names.

“This is a very common offence, and I am not prepared to make auch an order.” the Magistrate said. THEFT

Lascelles), was convicted and remanded on bail to December 16 for sentence on two charges of theft involving £5O 3s on November 20 and between November 15 and December 1. She pleaded guilty. A young man, whose name was suppressed, was discharged without conviction under section 42 of the Criminal Justice Act on charges of assault and being unlawfully in a garden in St. Albans on November 27. He pleaded guilty to both charges, and was represented by Mr R. G. Blunt. The accused was ordered to pay £2O towards the cost of prosecution, £lO of this amount to be paid to the complainant.

A youth, whose name was suppressed (Mr P. G. S. Penlington), was similarly discharged on a charge of assault on November 17. He pleaded guilty. He was ordered to pay £5 towards the cost of prosecution and £9 restitution. ATTEMPTED THEFT Charged with attempted theft of petrol valued at 7s on October 17. Boyce Terry Young, aged 17. a workman, was convicted and remanded on bail to December IS for sentence. He pleaded guilty. STOLE TRAILER Appearing for sentence on a charge of theft of a trailer valued at £7O between August 8 and Auguet 11 at Invercargill. Vincent Stanley Ladbrook, aged 28. a fibreglass worker, was fined £2O. An order was made for the return of the property. BENCH WARRANT ■ A bench warrant was issued for the arrest of Hayton George Williams. aged 38, a truck driver, when he fatted to appear

on a charge of awault oo September 9. REMANDED Leslie John Wanhalla. aged 18, a fisherman, was remanded on bail to December 18 on charges of assault and obscene language and joint chargee of burglary and theft. Desmond Hames, aged M, a workman, and Barry John NichoUs, aged 21, a refuse collector, were remanded on ball to December 18 on a charge of stealing whisky valued at S 3 7s od. on December 2.

Maxwell Carlton Carney, aged 41, a labourer, was remanded tn custody to December 16 on a charge of threatening to kill hts wife on December 1. A youth, whose name was suppressed, was remanded on bail to December 16 on charges of being found lurking near a house on October 9 and peering into a window on October 6.

Edwin Pyott, aged 22. a sheetmetal worker, was remanded until today for a medical examination to see whether he is fit to be sent to a periodic detention centre. He was appearing for sentence on charges of assaulting and obstructing a constable.

Appearing on a bench warrant issued at Auckland on September 15, when he failed to appear on charges of driving while disqualified, behaving in a dieorderly manner, and using obscene language, (tarry Desmond Wheaton, aged 23, a car dealer, was remanded on bail to appear in the Auckland Magistrate's Court on December IS. Norman William Bradley, aged 30, a fencing labourer, was remanded on ball to December 16 on a charge of assaulting a constable on October 16. CHARGE ADJOURNED

A charge against Adelaide Elaine Gilligan-Kingsley, aged 27, a housewife, of Hl treating a year-old child at Nelson on February 24 last, was adjourned sine die. Sergeant Townshend said that Gilligan-Kingsley had been admitted to a mental hospital. STOLE SPANNER Charged with the theft of a spanner valued at £1 3s, the property of the Waimatri County Council, at Spencer Park on October 24, Peter Sherwin Murch, aged 20. a garage attendant, pleaded guilty and was convicted. The hearing was adjourned to December 16 for sentence.

Anthony John Howard, aged 23, was sentenced to three months’ imprisonment, to be served concurrently with a term of three months' imprisonment he is now serving, when he appeared for sentence on a charge of breaking and entering Victoria Chambers on November 5. The term of imprisonment is to be followed by one year’s probation. with the special conditions that Howard takes out a prohibition order and does not associate with persons not approved by the probation officer. He was also ordered to pay a fine of £lO, and restitution of £5, during the term of probation.

Mr G. B. Joyce, who appeared for Howard, said that Howard was in gaol for throwing glass on the road In Dunedin and absconding while on bail. The Magistrate said that Howard had recently been released from prison after serving nine months' imprisonment for burglary. FALSE PRETENC Brian Pringle, aged 25, a workman, was further remanded in custody for sentence on 22 charges of false pretences. A sentence of one month’s imprisonment was imposed on Terence Joseph Foote, aged 47, a casual gardener, when he appeared for sentence on a charge of being idle and disorderly on November 24.
