SENTENCE QUASHED

Youth Given Probation (N.Z. Press' Association) WELLINGTON, Feb. 17. A sentence of borstal training imposed in the Hastings Magistrate’s Court in November last on Jeffery Lawrence McCormack, aged 17, a workman, on five charges of burglary, one of attempted burglary and one of theft was quashed on appeal by Mr Justice Thompkins in the Supreme Court today.

His Honour admitted: McCormack to probation for two years, special conditions being that he make restitution of £6 14s and that his place of employment and his associates be approved by the probation officer. The Offenders Probation Act was meant to help particularly persons who lapsed into crime for the first time and where there was a good chance of rehabilitating themselves if given the opportunity, his Honour said. In the present case it seemed there was an excellent chance of rehabilitation. The appellant was young and it was his first time in trouble.
