POULTRY FOOD CARTAGE

Licence Upheld

An appeal by the general manager of railways against a decision of the No. 9 Transport Licensing Authority (Mr J. S. Haywood) on August 26, granting a licence for the cartage of poultry foods to Wood Brothers, Ltd., has been disallowed by the Transport Licensing Appeal Authority (Judge K. G. Archer). In the decision the Authority says a previous application by Wood Brothers for a licence to carry its poultry foods was refused on October 30, 1963, and an appeal was also disallowed. On a subsequent application a licence was granted with exemption over the area between the Ashburton and the Hurunui rivers. The evidence before the Authority on the second occasion was stronger than that previously relied on, and was such as to satisfy him. The Appeal Authority said, however, he was concerned to find the respondent company had, in spite of the refusal of the original application made a considerable number of deliveries in breach of the regulation. The No. 9 Authority would have been entitled to be satisfied of the company’s readiness to comply with the regulation before granting the exemption, but it was understood it was the view of the Authority that the matter had been adequately dealt with elsewhere.
