Punter’s Claim Against A.J.C. Stewards Fails

The claim was brought by Percy Archibald McDonald, a pensioner, against toe stipendiary stewards, Messrs J, Bourke, K. Steindl, D. Heath, D. Ryap,. L, Sharpe and M. Smith for toe amount of money lest in bets because of alleged maladministration by th? stewards. McDonald alleged toe stewards had wrongly upheld a protest lodged by the jockey, George Moore, against a horse named Florida Keys in toe Flying Handicap at Rosehill last February. The action further alleged that the stewards' decision was influenced by their association with a betting plunge on toe horse to which they gave toe decision, and that

Moore conspired with a certain AJ.C. steward. In his submissions today. McDonald, who representeq himself, alleged toe stewards were corrupt and criminal in their actions.

"The stewards themselves bet on horses in races through a bookmaking organisation,” McDonald submitted, “They bad money bn Moore’s horse. That's why they upheld bls protest.” “One of the most interesting cases I think I have ever beard,” said Judge Stephen, “But I do not think you have any eatise for action. “You say the stewards are corrupt and criminal and that may be a legitimate reason for bringing this action, but it is not framed within toe law and therefore you have little chance of succeeding with your claim. I will dismiss your action without prejudice, "Therefore you will be able

to bring a fresh action framed In the correct manner, if you so desire, but I suggest you consult a solicitor first" McDonald thanked Judge Stephen for his "excellent advice” and said: "I’ll have another actiqn opt within 48 hours."
