MAGISTRATE’S COURT Youth Convicted On Three Of Nine Traffic Charges

Two traffic officers who separately stopped a car on the evening of March 15 brought nine traffic charges against the owner of the car, Stuart Donald Carton, aged 17, a mechanic (Mr M. J. Glue), in the Magistrate’s Court yesterday. Four of the charges were brought by Traffic Officer D. Brain and five by Traffic Officer L. R. Stringer.

Carron pleaded guilty before Mr E. A. Lee, S.M., to charges of driving while disqualified, failing to give his name and address, and having insufficient lights.. He pleaded not guilty to a charge of permitting dangerous riding bn a motor-vehicle. He also pleaded not guilty to the charges brought by Traffic Officer Stringer of driving while disqualified, failing to stop at a compulsory stop sign, giving false information as to the driver of a car, driving in a dangerous manner, and having insufficient lights.

He was convicted on the charges to which he pleaded guilty. For driving when disqualified he was fined £4O, and his disqualification was extended for one year. He was finqd £5 for failing to give his name and address, and £2 for having insufficient lights. The six other charges were dismissed. Traffic Officer Brain said that he saw a car being driven in Memorial avenue with only one parking light showing. He then noticed two youths sitting on the back bumper bar, waving their legs in the air. When he stopped the car he saw one of the youths change places with the driver. He could not get any response from the youths in the car, and when he returned after calling for assistance he found that two of the youths had run away and the other two were trying to get into his patrol car. Mr Glue submitted that there was no proof that Carton had allowed the youths to ride on the back of the car. Carron was a disqualified driver, and admitted the other offences, Mr Glue said.

In convicting Carron on three of the charges and dismissing the one of permitting dangerous riding on a vehicle, the Magistrate warned Carron that the next time he offended he would be sent to prison. “You are a persistent oL fender, and it is only your age that stops me from sending you to prison this time,” he said. ■

Traffic Officer Stringer gave evidence that later in (he evening he saw the same car being driven with only one light showing, further up Memorial avenue. He caught a glimpse of the driver,’ whom he later believed to be Carron.

When he turned -to give chase, the car increased speed to between 45 and 52 miles an hour. It did not stop when he made three or four attempts to stop.it, using a red light and siren, and then it failed to stop at a compulsory stop sign. The car weaved back and forwards across the road all this time, and when it stopped in Morley street the two occupants ran away.

Carron denied that he was the driver of the car on this Occasion.

Robert Alistar Bergman said in evidence that he had driven the car, and had not stopped because they had been in trouble earlier in the evening.

The Magistrate said that the identification of the driver was not certain, and dismissed the charge.

Bergman, aged 16, unemployed (Mr G. R. Lascelles), pleaded guilty to giving false information to Traffic Officer Brain, and to riding in an unsafe position. He pleaded not guilty to failing to give his name and address.

He was convicted on the three charges, fined £lO for giving false information, £3 for failing to give his name and address, and £2 for tiding in an unsafe position. Keith Alistar Millar was also fined £2 on a charge of riding in an unsafe position, to which he pleaded guilty.

Charged with assaulting a policeman in the execution of his duty, Maureen Janice Galbraith, aged 24, a factory worker, pleaded guilty. She was convicted and fined £B. Senior-Sergeant G. M. Cleary said that when Galbraith was in a cafe with her husband a dispute developed over the bill. The accused had been drinking, and the proprietor asked her to leave. She was taken outside by her husband and a constable, and she then struck the constable on the face. The accused said she was sorry about the assault,. but the bill had been paid. ASSAULT

“I will take into account the fact that you were called these names, otherwise I would impose a heavier penalty,” said the Magistrate when Eugene Earl Tamou, aged 22, unemployed, pleaded guilty to assaulting Peter Davis. He was convicted and fined £lO.

Detective Sergeant D. C. Lee ’said that Tamou and Davis collided while cycling in Barbadoes street. Davis called Tamou names, and Tamou knocked him down and fractured his nose. FINED £l5 “The Court is not prepared to tolerate this sort of behaviour,” said the Magistrate when Ivan James Penny, aged 30, a carpenter," pleaded guilty to a charge of assault on June 16. Penny was convicted and fined £l5. Senior-Sergeant Cleary said that Penny had an argument with his wife, Patricia Ann Penny, and struck her. When she struck him he twisted her arm, forced her on the floor, and pushed her against the wall. He also kicked her. Penny said he pleaded guilty, but denied the facts as stated by the' police. REMANDED Patrick James Neil Galbraith, aged 32, charged with using insulting language at the Central Police Station and with obtaining 12s credit by fraud, both on June 16, pleaded guilty to the first charge and not guilty to the second. He was remanded on bail until. June 25. Charged with the theft of £lOO on March 9, Ivan Hristoff Stoykoff, aged 40, an attendant, was remanded on bail until June 25. . Charged with committing sodomy on a boy aged 15 on May 3, Cyril Hoey Wells, aged 43, a painter, was remanded in custody until June 24.
