MAGISTRATE’S COURT Driver Fined £l5, With Year’s Loss Of Licence

Frank John Shuter, an auto machinist, was fined £l5, with cancellation of his driving licence for a year, when he was convicted in the Magistrate’s Court yesterday of driving in a manner which might have been dangerous on January 2. Mr E. S. J. Crutchley, S.M., was on the bench. Shuter, who was represented by Mr D. H. Hicks, pleaded not guilty. Traffic Officer R. N. Etwell said he was at Little River when two cars passed going towards Christchurch. He gave chase, and checked a 1937 V 8 coupe driven by Shuter at speeds of up to 75 miles an hour. Shuter passed four cars on a bend. On the straight approaching Motukarara Shuter increased speed to 75 miles an hour and passed a number of cars. Traffic was heavy. Shuter, giving evidence, said he saw the traffic officer’s car at Little River. He had sufficient visibility on the bends, which were not sharp, to complete the overtaking movements without danger. The Magistrate said that the charge had been established. CARELESS DRIVING On a charge of careless driving, Valmai Winifred Maslin, who did not appear, was convicted and fined £5, and her licence was cancelled for three months. . Traffic Officer J. E. L. Hume said that on March 5 the defendant had been parked on the Main South road near the intersection of Garvins road. She pulled out to execute a U-turn, and collided with a car travelling along the Main South road. Both cars were extensively damaged. There seemed no reason for the defendant not to see the oncoming car. FINED £3 “This is a case where the defendant was not deliberately breaching the law,” said the Magistrate when convicting Alan Frederick Swift, aged 36, a storekeeper, of passing a compulsory stop sign when the way was not clear. Swift pleaded not guilty. He was fined £3. Traffic Officer J. Ross said that on February 27 he saw the defendant stop at the compulsory stop sign in Clyde road, and then turn left into Riccarton road, forcing three or four cars travelling along Riccarton road to swerve across the white line. Swift said he had considered there was ample room for him to turn without obstructing traffic. COSTS ONLY To a charge of failing to display a warrant of fitness in Yaldhurst road on January 11, Ivan Keith Cook pleaded not guilty. He was convicted and ordered to pay costs. REMANDED Charged with assault at Christchurch on May 25, Leslie George Whitehead, aged 32, pleaded not guilty. He was remanded on bail until June 5. DISMISSED Charged with crossing against traffic lights, Terence McCormick pleaded not guilty. The charge was disTraffic Officer J. F. McKee said that on March 19 he saw the defendant cross the Straven road-Riccarton road intersection against the red light. McCormick said that the light changed to amber just as he commenced to cross the intersection. Just before he reached the other side, they turned red. The Magistrate said there was some conflict between the evidence of the traffic officer and of the defendant, and therefore the charge would be dismissed.

Dale, Justices of the Peace) CHARGED WITH RAPE After repelling the advances of one man at a party on the evening of May 5 at a house in Gloucester street, a girl was locked ip a room at the hoiise and raped by another man. Sergeant S. W. Byers said when Harry Edmunds, aged 22, a workman, was charged with rape. The accused. pleaded not guilty, and was represented by Mr W. A. Wilson. JUDGMENT FOR PLAINTIFFS Judgment was given for the executors of the estate of James Doling in a claim against Anthony David Rogal, a shopkeeper, for possession of a car valued at £750. The trustees are Henry Palmer, a retired farmer; Glen Watson, a workshop employee, and Edmund Michael Malley, a solicitor. Mr G. T. Mahon appeared for the plaintiffs and Mr H. W. Thompson for Rogal, who contested the claim. The plaintiffs also claimed £lOO for alleged wrongful detention of the car, but this claim failed. The plaintiffs were awarded costs. The Magistrate said he found Rogai’s evidence unreliable. He had given various accounts of how the Ownership .papers had come into his possession. Doling had instructed the defendant to look after the car. He was satisfied that Rogal had by no means discharged the onus of proving that the car was given to him.
