MAGISTRATE’S COURT Fine Of £l5, With 18 Months’ Loss Of Licence

A motorist who said he thought the red light of a patrol car and a torch flashed by a traffic officer in the patrol car meant that another motorist was “having a joke” was followed by the traffic officer for one and a half miles in Pages road on April 4 at speeds of 40 to 55 miles an hour, Traffic Sergeant H. J. McMorran said in the Magistrate’s Court yesterday before Mr K. H. J. Headifen, S.M.

The motorist, Richard Ernest Brown, aged 20, a welder, pleaded guilty to a charge of driving at a speed which might have been dangerous. He was convicted and fined £l5, and was disqualified from driving for 18 months. A traffic officer attempted to stop Brown after he had been seen driving at high speed, but Brown increased speed, Sergeant McMorran said. When asked why he had not stopped Brown said he . did not realise it was a traffic officer .signalling him, but thought it was someone having a joke. DISQUALIFIED DRIVER Graeme Edwar.d Crowley, aged 18, a carpenter, pleaded guilty to a charge of driving while ’ disqualified in Cathedral Square on May 7. He was convicted and fined £2O, and was disqualified from driving for a further year. For Crowley, Mr M. J. Glue said he became annoyed with the manner a friend was driving his car, so he took the wheel even though he was a disqualified driver. When stopped Crowley readily admitted that he was a disqualified driver.

“The Court regards this kind of offence as being very serious, and if you had not admitted you were disqualified you would have gone to gaol,” the Magistrate said to Crowley. LOSES LICENCE Winfrey John Lincoln was fined £5, and his driver’s licence was cancelled for a year, when he was convicted of riding a motor-cycle at a speed which might have been dangerous. He pleaded not guilty, and was represented by Mr I. White. Lincoln had ridden through a residential area and across intersections at speeds of up to 60 miles an hour, the Magistrate said. The offence was committed at 12.40 a.m. on November 15. The defendant was showing some exuberance after finishing his university examinations, Mr White said. CHARGES DISMISSED Arthur Walsh Schofield appeared on charges of careless use of a motor-vehicle in Papanui road on March 25 and failing to stop after an accident. Schofield, a truck salesman (Mr A. K. Archer), pleaded not guilty. The charges were dismissed.

Lionel Thomas Paul said a car went to overtake him in Papanui road, swung in suddenly, and hit the front bumper bar of his car. The vehicle did not stop. Schofield said in evidence that as he went to pass he saw a broken wooden box in the road and swung to avoid it. He did not realise he had hit the other ear. The Magistrate said he accepted the evidence of the defendant, and as the-defendant had no knowledge of the slight collision taking place, he had no reason to stop. DISCHARGED When his licence was returned to him before his period of disqualification from driving had ended, Harold Alexander Mora believed he could drive because he had his licence back, said Mr L. R. Moore, who appeared for Mora. Mora, a labourer, pleaded not guilty to a charge of driv ? ing while disqualified on May 9. He was discharged under section 42 of the Criminal Justice Act. The Magistrate said he believed Mora made a mistake and did not make any wilful attempt to break the law. CARELESS DRIVING “If you come before the Court again for this type of driving behaviour your licence will be taken away for several years, as you are becoming a menace on the road,” said the Magistrate when fining Wayne John Maynard £l2 on a charge of careless driving on July 10. Maynard was ordered to attend a course of City Council driving lectures. Maynard was originally charged- with driving at a speed which might have been dangerous. He pleaded not guilty to this charge, and was represented by Mr R. G. Blunt. The charge was reduced by the Magistrate after the prosecution’s case had been presented. A plea' of guilty was entered to the amended charge. Traffic Officer D. Beattie said he checked Maynard riding a motor-cycle along Pages road over Shortland street at 55 miles an hour.

Maynard said his machine was giving trouble, and he gave it a short burst of speed to clear it. He denied doing 55 miles an hour over the Shortland street intersection and said that he had had intended to turn down Shortland street until he saw the “Stop” light being flashed at him from the microwave unit. . “NOMINAL” FINE Frederick Kevin Morris was fined 10s on a charge of failing to comply with the traffic lights at the corner of Manchester, High, and Lichfield streets on March 20. He pleaded not guilty, and conducted his- own defence.

It was a technical offence and had not been committed deliberately, said the Magistrate. A nominal fine would be imposed. CHARGE DISMISSED A charge of parking in Liverpool street without reasonable consideration, against Rutherford Miln, was dismissed. He pleaded not guilty, and conducted his own defence. . Traffic Officer W. J. Noster. said that after a complaint was received he found a sports car parked over a vehicular entrance to the T. and G. Building. It. was not locked, and he moved the car.
